BMC, Table 38.320.050 “form and intensity standards for mixed-use and other non-residential buildings” 70’ building height requirement to top of roof structure in buildings zoned B-3. BMC, 38.350.050.D.2.c. “scenery lofts are exempt from height limitations otherwise established in this chapter, provided that no linear dimension of any such structure exceed 50 percent of the corresponding street frontage line”. 1. The portion of our roof that exceeds above 70’ is a scenery loft, adding views to the interior space and bringing in natural light, while not adding any usable square footage. The linear distance of our scenery loft is ~60’ while our frontage along Main Street is 207’, this equates to 29% of the frontage, <50%.
PROPOSED DEPARTURE NARRATIVE:
No departure necessary as scenery lofts are exempt from height restrictions per BMC 38.350.050.D.2.c.
