VISION TRIANGLEBMC 38.400.100 (E) ‐ The building is not allowed to be located within the sight vision triangle. The review authority may grant a departure from the standards for intersections with traffic signals, intersections on one‐way streets, or intersections on streets classified as an urban route by the Montana Department of Transportation. 1. The project requests a departure from this code section and allow the building to encroach in the vision triangle as proposed. See the following full description of the condition and departure request.
PROPOSED DEVIATION NARRATIVE5th & Main holds a prominent corner location at the gateway to downtown creating a unique condition. the project is currently hosting the required 12’ setback off of the back of curb, but it holds the zero lot line condition allowed by storefront frontage at the residential floors above. The project aims to maintain a vision triangle, but carries the historic settlement of the zero lot line condition. The project proposes a column in the vision triangle under the precedent of buildings in the downtown fabric holding their urban corner and matching other signalized encroachements on main street. The intersection in question is singalized and the sidewalks are of an appropriate depth to allow proper pedistrian sighting by motor vehicles meeting the exception in the BMC.
