Variance Requests
VISION TRIANGLE
BMC 38.400.100 (E) - The building is not allowed to be located within the sight vision
triangle. The review authority may grant a departure from the standards for intersections with
traffic signals, intersections on one-way streets, or intersections on streets classified as an
urban route by the Montana Department of Transportation.
1. The projet requests a departure from this code section and allow the building to
encroach in the vision triangle as proposed. See the following full description of the condition
and departure request.
REAR ALLEY SETBACK
BMC, Table 38.320.050 "form and intensity standards for mixed-use and other non-residential
buildings" 5' setback at rear setbacks and alleys.
1. A 5' setback is present at the alley, however a portion of the footprint extends beyond the
guidlines set forth by the BMC. The condition along the alley takes place at the parking garage
and is described in the following departure narrative along with solutions and criteria for
approval.
