I am urging Commissioners to deny the application 22293 for development of the Shady
Glenn development for the following reasons:
1) The developer is asking for six exemptions to the city development code. This code wasdeveloped to insure the quality of neighborhoods in Bozeman; asking for six exemptions goes
against the goals of the code. Two of the exemptions include allowing townhouses in R-1zoning, and allowing for one access point to the development. One access point could result
in a safety hazard for the development and the surrounding neighborhoods. The proposedsecond access point would be gated, keeping inhabitants restricted to leaving on foot. As City
Commissioner Jennifer Madgic stated in the past, cul de sacs are not a way to promote trafficcirculation and public health and safety.
2) Access to the development would be via a private road - Birdie Dr. Maintenance of Birdie
drive is paid for by the HOA of the existing development. Allowing public access to theprivate road (including construction vehicles) adds undue financial burdens to the existing
community.
3) The developer is also requesting an exemption to allow reduced setback from wetlandsfrom 50 feet to 35 feet in 9 of the proposed lots. The request for this exemption flies in the
face of the need to protect sensitive wetlands, wildlife corridors, and the value of our Bozemanlifestyle. We have seen a marked increase in wildfires and drought during the past years;
reducing the westland setback is counter intelligent to what is happening to the environment.
For these reasons I strongly urge the City Commissioners to reject this application. Thank youfor considering this request.
