I oppose the Shady Glen Project application 22294.Specifically I oppose relaxations from the code. BMC 38.400.010.A8- A relaxation for the design of use access for emergency vehicles andother authorized vehicles.My concern with this relaxation is the gate that will be put in place, how will this road bemaintained during the winter months? How will snowplows be able to plow the entire road ifthere is a locked gate across the road? Who will have keys to the gate? This is a major safetyissue. The Bozeman fire marshall has expressed serious concerns about the need forimmediate access if there is an emergency. I also oppose relaxation BMC 38.410.100.A.2.c4 - A relaxation from watercourse setback andwetland buffer requirements. The relaxation request is to reduce the 50 foot setback to 35 feet. My concern is for loss of watershed and wildlife habitat as well as water quality of thiswatershed if private property, specifically lawns back up to it. How will the use of fertilizersbe monitored and/or controlled? Many fertilizers contain nitrates and other chemicals that canharm our watershed and wildlife.
