PUBLIC PEDESTRIAN ACCESS EASEMENT
FOR VALUE RECEIVED, BLACKWOOD LAND FUND, LLC, a Delaware limited liability
company, with a mailing address of 140 Village Crossing Way, Unit 3B, Bozeman, MT 59715,
the GRANTOR, does hereby grant to CITY OF BOZEMAN, a Montana municipal corporation,
with a mailing address of P.O. Box 1230, Bozeman, MT 59771, the GRANTEE, its successors
and assigns, a perpetual pedestrian access easement for the use of the public, in, through and across
a strip of land 10-feet wide situated in Gallatin County, Montana, to be located on the following
described real property:
Lot 1 and Park 11, Block 14, BLACKWOOD GROVES SUBDIVISION, PHASE 2, City of
Bozeman, according to the plat thereof, on file and of record in the office of the Clerk and
Recorder, Gallatin County, Montana, and located in the Southwest 1/4 of Section 24, Township
2 South, Range 5 East of P.M.M., Gallatin County, Montana
Subject to Public Utility Easements as shown on said plat.
The easement is more particularly shown and dimensioned on the attached Exhibit A, which by
this reference is made a part of this document.
The GRANTOR states that it possesses the real property described above and that he has a lawful
right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.
