You are correct the MSP did acknowledge the open space at the ratio you indicated. Hi Lynn, I have been working on addressing some of the comments for the Jennifer Place Condominiums Site Plan and have a question regarding open space. In your comment from 11/23/2022 you were referring me to a couple different locations in the code regarding open space calculations. I talked with the owner/architect and these buildings are intended to be two-household units, falling under section 38.362.220.E. Section E indicates a minimum of 10% area of the lot. This current code and the previously approved MSP (attached above with approval letter and staff report) contradict each other. Under the MSP approval, open space was calculated and approved at 10% of building area under section 38.360.240.E. My understanding is that since this site plan is a continuation under a previously approved MSP and that there would be no additional changes to the design of the site. Please let me know your thoughts on this.
