RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman,121 N.Rouse Avenue,Bozeman,MT 59715,a
Municipal CorporationoftheStateof Montana,theGRANTOR,does hereby releaseand reconvey
thefollowingdescribedeasement unto Great Western Investments,LLC,with a mailingaddressof
15525 Horse Creek Road,Bozeman,MT 59715,the GRANTEE,as follows:
WITNESSETH
WHEREAS theGrantor isthelegalrecordtitleholderof a publicutilityeasement situated
along the south lineofLot 1,Block 9,LaurelGlen Subdivision,Phase 1,Cityof Bozeman,[PlatJ-
374],GallatinCounty,Montana.
WHEREAS theabove publicutilityeasement was grantedby the filingoftheplatofLaurel
Glen Subdivision,Phase 1,[PlatJ-374],on January 22,2004 as Document Number 2138460,
recordsof the officeof the Clerk and Recorder,GallatinCounty,Montana.
WHEREAS the installationof utilityinfrastructurehas been completed without having to
occupy the portionof saideasement thatliesalong the southboundary of saidLot 1,Block 9,as
shown and dimensioned on the attachedExhibit A,which by thisreferenceismade a partof this
document.The terminationof saidportionof the 12 footwide publicutilityeasement willnot
adverselyimpact theGrantor'sinterests.
WHEREFORE,the Grantor does hereby releaseand reconvey toGreatWestern Investments,
LLC,the portionof the 12 foot wide public utilityeasement as shown and dimensioned on the
attachedExhibit A as being terminated,togetherwith any right,title,or interestthatthe Grantor
may have in saidpublicutilityeasement.The remaining publicutilityeasements locatedalong the
perimeterof saidLot 1,Block 9,shallremain intact.
