Your June 1, 2021 subdivision pre-application application for the above-referenced project
located within a B-2, Community Business zone with a Saccoccia/Lowes Planned Unit
Development (PUD) overlay was accepted for initial agency review and comment. Community Development staff preliminarily reviewed the application in accordance with the Bozeman
Municipal Code (BMC) Section 38.240.110 Pre-application submittal checklist and the application
meets those requirements. The Development Review Committee (DRC) reviewed the submittal
on June 23, 2021 and their comments are noted below. During this review, the Department
determined the pre-application submittal is inadequate with respect to a critical BMC
requirement: The proposed new Lot 2A2 does not show legal and physical access to a public or
approved private street pursuant to BMC Section 38.400.090.B.2. We would not be able to
accept a Preliminary Plat application that does not demonstrate compliance with this
requirement.
Further comments that must be addressed with a Preliminary Plat submittal for this project are

21212; 1st Review Comments on the Pre-Application Submittal for the Minor Subsequent
Subdivision of Lot 2A of the “Corrected Amended Plat of Minor Subdivision 407B of Lots 1 and 2
of the Saccoccia Minor Subdivision of 407”.

Please note that all code references noted below refer to the Bozeman Municipal Code (BMC).
1. Please double-check the legal description and correct title for this third subsequent
minor amendment to the “parent” Saccoccia Minor Subdivision. I see 407B and C for
this subdivision on different plats.
Please see the attached Preliminary Plat in the Plans folder for details.
2. Please demonstrate compliance with the following access provisions of the BMC:
a. 38.400.010.A.1. Providing access to adjacent undeveloped land; b. 38.400.010.A.8. Providing a second or emergency access;
c. 38.400.090.B.1 and 2 and
d. 38.410.030. Demonstrating legal and physical access to the proposed new Lot 2A2 from a public street or an approved private street. Simmental Way terminates at
the north end of its intersection with Baxter Lane. The access lane to the hotel to the
west and to the credit union site is not a public street, road or alley and does not meet
City standards. Creating a Lot 2A1 in the way shown on the application effectively
removes legal and physical access to the land labeled Lot 2A2. Please correct the plat
map to meet BMC standards.
In a call with the City of Bozeman on 7/20/21 it was agreed that if a 25’ pedestrian access easement (and a future 5’ sidewalk) on the southern
boundary of Lot 2A2 was added to the plat along with the existing Public
Street and Utility Easement (Document #2505421) on the west boundary – the application would meet the code. Please see the attached Preliminary Plat in the Plans folder for details.
3. Please show all the easements on the proposed new Lots 2A1 and 2A2 from previous
final plats.

4. Please show the public access easements on the new plat that are shown on the March 10, 2020 approved site plan for the Home 2 hotel project, Project No. 19394.

5. 38.220.050 and 060. Preliminary Plat Supplemental Information. Staff will not waive the Preliminary Plat Supplemental Information for the following resources: Vegetation,
wildlife, agriculture, agriculture water user facilities, streets, roads and alleys—TIS
study--, utilities and land use. Please provide this information with the Preliminary Plat
submittal.

6. Please demonstrate how this subdivision addresses the utilities, parks and open space,
and streets standards of the 2005 Saccoccia/Lowes PUD document (Project Z-05128).
Public Utility Easements have been provided on the Preliminary Plat, this is B-2 zoned and therefore has no Parks requirements, the 30% open space was given with the 2005 Saccoccia/Lowes PUD document (Project Z-
05128), access has been addressed above. Flexible Open Space - originally designated PUD flexible open space was only along
Baxter Lane and not in any subsequent internal lots. As part of the approved
Home 2 Suites Hotel, COB#: 19394 project, we encroached on 5,410 sq. ft. of that flexible open space but replaced it with an additional 31,442 sq. ft. of open space
contiguous to it as required. So in essence, we have more than enough total open
space for all 3 lots (RMCU, Lot 2A1 & Lot 2A2).
The formal Preliminary Plat submittal needs the following:
1. Within 1 year of Pre-Application meeting, submit a Preliminary Plat application [BMC
38.240] for a “subsequent minor subdivision per 38.240.130.5.a (1) and meeting the
submittal requirements of BMC 38.220.040.A, .050 and .060, 38.220.300, as well as the
Bozeman Preliminary Plat application check list;
Acknowledged – see this application.
2. Please show dimensions and please label all easements carrying over from the current
Corrected Amended Plat 407C and from the approved Home2Home hotel site plan
including (1) the 20’ wide pedestrian easement along the east and south sides of Lot
2A1 (the hotel Site); (2) the 25 ft perpetual common open space along the north side of
Lot 2A1; and (3) the 50 ft “flexible common open space on the north side of Lot 2A1.

A shared access easement was provided to the City of Bozeman as part of
the HOME-2 Suites Hotel, COB#: 19394 project. See the document titled
(Easement - EX C - Shared Access Easement 080119.pdf) in the
Documents folder for detail. Also provided with the HOME-2 Site Plan
were a Pedestrian Easement and a Public Utility Easement (files labeled

Easement - EX D - Pedestrian Easement 080119.pdf and Easement - EX A
- NWE easement 080119.pdf in the Documents folder). These Easements
were submitted to the City of Bozeman, and to date have not been filed at
the Clerk and Recorders office.
3. Please provide all relevant and required Certificate blocks on Sheet 1 of the amended
plat per 38.240.410 through 38.240.530.

4. Please label the date of the revised plat map.

5. Please add an “M” after P.M. in the legal description of the location.

6. Please carry over all easements shown on the recorded “parent” plat including a 50-ft.
“Flexible common open space” easement along the northern edge of the proposed new
Lot 2A1. The 2015 Corrected Amended Plat shows a “40’ access and utility easement,
Doc.2143197” and, I believe, it is a “45’ access and utility easement”; please make that
correction.

7. Please include easements on the amended plat that were approved by the Site Plan for
the Home 2 hotel, Project No. 19394. These include a 24-ft. perpetual common open
space easement; and a 20-ft wide pedestrian easement that meanders from the north
along the east side of the Lot to its southern extent and then meanders westward to the
west property line.
Please label the width of the “Proposed shared access easement” along the western
boundary of new Lot 2A1 and delete the word “proposed” and the recording of this plat
makes it permanent
