See Gallatin County Recorded Doc. #2143197 for the 45' public street and utility easement for
Baxter Lane. Minor Subdivision 407 shows the 45' strip as dedicated right—of—way, but the City
of Bozeman and Gallatin County both view it as a public street and utility easement. The intent
of this corrected plat is to clarify it as a public street and utility easement, not a dedicated
right—of—way. Witness corners are 45.01 ft. from lot corners. See M/S 407.

§76-3-101 et.seq., MCA, and the Bozeman Unified Development Code.
I further certify that this amended plat is within the City of Bozeman, Montana, a first—class
municipality, and is within the planning area of the Bozeman growth policy which was adopted
pursuant to Section 76-1-601 et seq., MCA, and can be provided with adequate storm water
drainage and adequate municipal facilities. Therefore, under the provisions of Section
76-4-125(2)(d), MCA, this subdivision is excluded from the requirement for Montana Department
of Environmental Quality review.
