D WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT
GallatinCounty,Montana,theGRANTOR,inconsiderationof$1.00andothergoodand
valuableconsideration,receiptofwhichisacknowledged,grant(s)toCityofBozeman,
Bozeman,Montana,GRANTEE,itssuccessorsandassigns,aperpetualeasementtolay,
constructandmaintainsanitarysewerpipelineswiththeusualservices,valves,connections,
accessoriesandappurtenancesforthepurposeoftransmittingsanitarysewagein,through,and
acrossastripoflandsituatedinGallatinCounty,Montana,twenty(20)feetwidetobelocated
onthefollowingdescribedrealproperty:TractsA andB CertificateofSurvey691andaparcel
asdescribedin_DocumentFilm5Page146.lessdedicatedright-of-wayperCertificateof
Survey429inBozeman,Montana.
TheeasementismoreparticularlydescribedontheattachedExhibitCwhichbythis
referenceismadeaparthereof.
ThisgrantincludestherightoftheGRANTEE,itssuccessors,permittees,licensees,and
assignstheiragentsandemployees,toenteratalltimesupontheabove-describedlandbyusing
existingroadsortrailsorotherwiseby aroutecausingtheleastdamageandinconveniencetothe
GRANTOR inordertosurveyandestablishtherouteandlocationoftheeasementandthe
pipelineandto:
(1)Construct,operate,patrol,repair,substitute,remove,enlarge,replace,andmaintainthe
pipeline,services,connections,accessoriesandappurtenances;
(2)Trim,remove,destroy,orotherwisecontrolanytreesandbrushinsideoroutsidethe
boundariesoftheeasementwhichmay,intheopinionoftheGRANTEE,interfereor
threatentointerferewithorbehazardoustotheconstruction,operationandmaintenance
ofthepipeline;
(3)Gradethelandsubjecttothiseasementandextendthecutsandfillsofthisgradinginto
andonthelandadjacenttothatwhichissubjecttothiseasementtotheextentGRANTEE
may findreasonablynecessary;and
(4)SupportthepipelineacrossravinesandwatercourseswithstructureswhichGRANTEE
deemsnecessary.
THE GRANTEE AGREES:
(1)That,inconnectionwiththeconstruction,operating,patrolling,repairing,substituting,
removing,enlarging,replacing,andmaintainingofsaidsanitarysewagepipeline(s),it
willrepairorreplace,atitssoleexpense,orpaytoGRANTOR thereasonablevalueof
anydamagestogrowingcrops,existingfences,ditchesandotherappurtenancesofsaid
landthatmay bedisturbedbyitsoperation.
(2)That,duringoperationsinvolvingexcavation,itwillremovethetopsoilfromthetrenched
areatoa depthofonefoot,ortothefulldepthofthetopsoil,whicheverisless,and
stockpilesaidtopsoilforreplacementoverthetrench.Itwillremovefromthesiteany
largerocksorsurplusexcavatingmaterialoranydebristhatmay havebeenexposedby
theexcavationandremainsafterbackfillingiscompleted.And,itwillleavethefinished
surfaceinsubstantiallythesameconditionasexistedpriortothebeginningofoperations
exceptthatthesurfaceofbackfilledareasmay bemoundedsufficientlytopreventthe
formationofdepressionsafterfinalsettlementhastakenplace.
THE GRANTOR AGREES:
(1)Atnotimewilltheybuild,construct,erectormaintainanypermanentstructurewithinthe
boundariesofsaideasementwithoutthepriorwrittenconsentofGRANTEE.
(2)Atnotimewilltheymodifythefinishedgradeofthelandoverthepipelinebyremovalof
existingsoilorbyplacementoffillmaterialwithintheboundariesofsaideasement
withoutthepriorwrittenconsentoftheGRANTEE.
(3)Thatwherethesubjectimprovementsarenotlocatedunderimprovedpublicorprivate
streetsorotherprovidedaccess,a12footwideall-weatheraccessroadmay be
constructedwithintheeasementwhereattheCity'sdiscretionsuchaccessisrequiredfor
operationandmaintenancepurposes.
(4)TheGRANTOR(S)warrantsthattheyarelawfullyseizedandpossessedofthereal
propertydescribedabove,thattheyhavealawfulrighttoconveytheproperty,oranypart
ofit,andthattheywillforeverdefendthetitletothispropertyagainsttheclaimsofall
persons.
(5)TheGRANTEE may peaceablyholdandenjoytherightsandprivilegeshereingranted
withoutanyinterruptionbytheGRANTOR.Theterms,covenantsandprovisionsofthis
easementandagreementshallextendtoandbebindingupontheheirs,executors,
administrators,personalrepresentatives,successorsandassignsofthepartieshereto.
