COMMISSION RESOLUTION NO. 3121
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF BOZEMAN,
MONTANA, DECLARING IT TO BE THE
COMMISSION'S INTENTION TO
CLOSE
SOUTH THIRD AVENUE
AT A POINT
BETWEEN ITS
INTERSECTIONS WITH SOUTH GRAND
A VENUE AND KAGY BOULEVARD
BY INSTALLING A CUL-DE-SAC IN
SAID STREET.
WHEREAS, the City has received
a written petition from owners of lots on the
portion of the street that would be closed as a result of installing a cul-de-sac at a point
between South Grand Avenue and Kagy Boulevard; and
WHEREAS, the cul-de-sac will
be constructed on South Third Avenue at a point to
be determined by the Director of Public Service, following public comment; and
WHEREAS, pursuant to Section
7-14-4114, Montana Code Annotated, the City
Commission may act upon said petition, after appropriate notice has been published; and
WHEREAS, the City Commission
has determined it appropriate and in the best
interests of the City to proceed with the process for closure of South Third Avenue at a
point between its intersections with South Grand Avenue and Kagy Bouelvard.
NOW, THEREFORE, BE IT RESOLVED
by the City Commission of the City of
Bozeman, Montana, that:
Section 1
Declaration of Intention
The City Commission states its
intention to close South Third Avenue by installing
a cul-de-sac at a point between its intersection with South Grand Avenue and Kagy
Boulevard, with the exact location to be determined by the Director of Public Service.
Section 2
Public Hearina
A public hearing on this petition
requesting closure of said street is hereby set to be
held at the Commission Room in the Municipal Building, 411 East Main Street, Bozeman,
Montana, on Monday, June 17,1996, at 7:00 p.m., at which time public testimony will be
received in support of and in opposition to said petition.
Section 3
Notice
The Clerk of the Commission of
the City of Bozeman is hereby directed to publish
a notice in the Bozeman Daily Chronicle a Notice stating the time and place of the public

hearing, and stating that the City Commission will act upon petition for closure of South
Third Avenue.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular session thereof held on the 3rd day of June 1996.

NOTICE IS HEREBY GIVEN that the
City Commission did, on the 3rd day of June
1996, adopt Commission Resolution No. 3121, entitled:
COMMISSION RESOLUTION NO. 3121
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DECLARING IT TO BE THE
COMMISSION'S INTENTION TO
CLOSE SOUTH
THIRD AVENUE
AT A POINT
BETWEEN ITS
INTERSECTIONS WITH SOUTH GRAND A VENUE AND KAGY BOULEVARD
BY INSTALLING A CUL-DE-SAC IN
SAID STREET.
NOTICE IS FURTHER GIVEN that,
at 7:00 p.m. on Monday, June 17, 1996, the City
Commission will conduct a public hearing on this intention to close South Third Avenue at
which time testimony in support of and in opposition to said closure will be accepted at
which time the Commission will act upon the petition to close this street.
