HomeMy WebLinkAbout22- Waiver of Right to Protest Creation of SUD - Nelson Meadows Lot 18Inter-officeOriginalto: CityofBozernan 2793818 CityClerk 20 o os ø PM Fee .00 8 z an T 59771-1230 WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL DISTRICT OR SPECIAL IMPROVEMENT DISTRICTS NELSON MEADOWS LOT 18 The undersigned owner of therealpropertysituatedinthe County ofGallatin,Stateof Montana, and more particularlydescribedas follows: LOT 18 OF THE NELSON MEADOWS SUBDIVISION LOCATED IN THE SE ¼OF SECTION 22,TOWNSHIP 1 SOUTH,RANGE 5 EAST,BLOCK 4,P.M.M.,GALLATIN COUNTY,MONTANA IN CONSIDERATION of receivingapproval for VISTA LLC SITE PLAN of the subject propertyfrom the City of Bozeman,along with accompanying rightsand privilegesand for otherand valuableconsideration,the receiptof which ishereby acknowledged,and in recognitionof the impacts to STREETS &INTERSECTIONS which willbe caused by thedevelopment ofthe above-described property,the owner has waived and does hereby waive foritself,itssuccessorsand assignsforeverthe rightto protestthe creationof one or more specialdistrictsor specialimprovement districtsforthe designand engineering,constructionand maintenance of followingimprovements: a.Streetimprovements to PrinceLane between Nelson Road and Frontage Road including lighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. b.Streetimprovements to Royal Wolf Way between Nelson Road and northernright-of-way establishedwith theNelson Meadows Subdivisionplatincludinglighting,signalization, paving,curb/gutter,sidewalk,and storm drainage. c.Streetimprovements toNelson Road includinglighting,signalization,paving,curb/gutter, sidewalk,and storm drainage. d.Streetimprovements to Frontage Road between Nelson Road and East Valley Center Spur/PrinceLane includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. e.Intersectionimprovements atPrinceLane and Nelson Road includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. f.Intersectionimprovements atPrinceLane and Royal Wolf Way includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. g.Intersectionimprovements atPrinceLane and Frontage Road Avenue includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. h.Intersectionimprovements atRoyal Wolf Way and Nelson Road includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. i.Intersectionimprovements toNelson Road and Frontage Road includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. j.Intersectionimprovements to EastValley Center Spur and Frontage Road includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. Landowner agrees the City has the sole rightto controlthe design and constructionof such improvements and may include any of the above components and othersnecessary to ensure such improvements comply with all adopted City infrastructureplans and requirements.Further,the Landowner waives itsrightor to make any writtenprotestagainstthe sizeor area or creationof the districtbe assessed in response to a duly passed resolutionof intentionto createone or more special improvement districtswhich would includethe above-describedproperty. In theevent a specialdistrictor specialimprovement districtisnot utilizedforthecompletion of these improvements,the developer agrees to participatein an alternatefinancing method for the completion of saidimprovements on a fairshare,proportionatebasisas determined by the City on the 2 basisof the squarefootage of property,taxablevaluationof the property,trafficcontributionfrom the development or a combination thereof. This waiver ismade forthebenefitof the propertydescribedhereinshallbe a covenant running with the land. The terms,covenants and provisionsof thiswaiver shallextend to,and be binding upon the successors-in-interestand assignsof the Landowner. DATED this day of 022.
