SITE PLAN NARRATIVE AND APPLICATION SET CHECKLIST
1. Create and submit a Planning application using the ProjectDox portal;
Response: Application submitted through ProjectDox Portal.
2. Project narrative describing the project type, proposed use scope, size (dwellings, building size(s), building height(s), number
of buildings, number of total parking spaces) intent, and phasing, if applicable. The narrative must include a response to the
City’s conceptual review comments. If requesting a waiver from conceptual review, a letter from the director must be included.
Response: The new Gallatin County Courts Building will replace the existing Gallatin County Law & Justice building housed in
the original Catholic High School building. Currently the existing Law & Justice building is home to the City of Bozeman Police
Department, City of Bozeman Municipal Courts (2), Gallatin County Sheriff Operations, Gallatin County Justice Courts (2), Gal-
latin County District Courts (3), Youth Court Services, Victim Services, Court Clerk operations for all Courts, and other support
operations.
Due to several programming shifts with both the City of Bozeman and Gallatin County, many current functions will be relocated
from the Law & Justice Campus. The City of Bozeman will be moving the Police and Municipal Courts operations to the new
Bozeman Public Safety Center in summer 2022. The Gallatin County Sheriff Operations have already relocated their patrol and
training operations to a new facility at Four Corners. Remaining Sheriff Operations will also be relocating to the Four Corners
site concurrent with Gallatin County moving into the new Courts Building. As a result of these occupancy shifts, the new Gallatin
County Courts Building will be a Courts specific operation.
The new Gallatin County Courts building will house Gallatin County District Courts (4), Gallatin County Justice Courts (2), Stand-
ing Master Hearing Room (1), associated Court Clerk service areas, Judge and Jury suites, Youth Court Services, and a small
Courts Security area for Sheriff staff assigned to Court Security.
In total the existing Law & Justice Facility (including the stand-alone Court #3 Building) provided 63,709 square feet of occupied
space. The new Gallatin County Courts Building will provide 69,128 square feet of occupied space. The net building square
footage add to the site will be 5,419 square feet.
The new Gallatin County Courts Building is designed to provide necessary security for public, staff, and in-custody persons. In-
dependent circulation corridors are provided along with secure parking and access for building staff.
Due to the on-going Gallatin County operations, the project will be developed in a sequence that will allow continuous operations
while construction occurs. Initial site preparation will include selective site demolition and installation of a gravel basecourse / fill
for the building pad. Construction is planned to begin in the fall with foundations and utility work, followed by masonry and struc-
tural steel framing. Construction is anticipated to take between 20-24 months.
During construction the existing parking area south of the existing Law & Justice building will be utilized for staff and visitors to
the building. This area is planned to remain as-is after completion of the project to provide overflow parking for the new Gallatin
County Courts building. This zone of the site will remain unoccupied until such time Gallatin County determines additional ser-
vices may be needed.
Upon completion of the new Courts Building occupants of the existing Law & Justice building will move into their new space.
This includes Sheriff operations relocating to their new home at Four Corners. Once all occupants are moved out of the existing
Law & Justice building, the structure will be demolished and removed. Final site development work will occur including construc-
tion of a new park / open space at the center of the campus.
Waiver of Concept review is included as attachment to this Narrative and Checklist.
3. Noticing Checklist Form N1 and materials
Response: Included in Documents folder with filename 02 – N1 Noticing Checklist_GCC
4. For departures, a departure narrative must be provided stating which Section(s) of the Bozeman Municipal Code are proposed
for departure, the scope and extent of the proposed departure(s) and a response to the required departure criteria. A summary
and response to the criteria must be provided for each departure.
a. Project applicants must successfully demonstrate to the review authority how the proposed departure
meets the purpose(s) of the standard and other applicable departure criteria that apply to the specific
standard.
b. Either through a separate exhibit of departure request within the narrative or through a site plan or building eleva-
tion, clearly show any proposed departure related to the request. Ensure that the separate sheet number is refer-
enced in the departure narrative.
Response: No departures are being requested for this project.
5. Traffic study. Street, traffic, and access information required in Section 38.220.060.A.12, BMC or a waiver, in writing, from the
Engineering Division that the requirement is waived prior to application submittal.
Response: Included in Documents folder, filename 03 – Trip Generation Summary_GCC and 04 – Traffic Study L&J. Note
this includes the traffic study completed in February 2016 for the Gallatin Law and Justice Center Campus Master Plan, and sub-
sequent Trip Generation Summary to reflect the current scope of the campus.
6. Water rights information. If cash-in-lieu is proposed a cash-in-lieu of water rights calculation and payment amount certified by
the City’s Engineering Division.
Response: In review with City Engineering, please see correspondence included in Documents folder with filename 05 –
CILWR Correspondence – G Nielsen. Water rights information can be determined concurrent with Site Plan Application review.
7. If water wells are proposed, a letter is required from the Montana Department of Natural Resources and Conservation
confirming their intent to issue a permit or exemption.
Response: No new water wells are proposed. Irrigation connects to existing well and existing irrigation.
8. Stormwater Design Report
Response: Included in Documents folder with filename 06 – Stormwater Drainage Report and 07 – Stormwater Maintenance
Plan.
9. Digital copy(ies) of most current plat and existing easements if recorded separately from the plat.
Response: Included in Drawings folder with filename 002_C001 SITE TOPO AND UTUILITES PLAN of existing site condi-
tions.
10. If Concurrent Construction is requested. Concurrent Construction must be requested at time of Site Plan application per
Section 38.270.030, BMC. For Site Plans requiring public infrastructure extensions or upgrades on site or directly adjacent to
site use CCON checklist. For Site Plans requiring off-site public infrastructure improvements use CCOFF Checklist.
Response: Included in Documents folder with filename 08 – CCON_GCC. Note scope of adjacent public infrastructure is con-
nection to West Dickerson Street that terminates at the west property line.
11. If the property is located within the Neighborhood Conservation Overlay District (NCOD), include Commercial Certificate of
Appropriateness (CCOA) or Demolition (DEM) applications and required materials.
a. You may only apply for deviations in conjunction with a development proposal. Standards and criteria for deviations are
contained in Section 38.340, BMC.
i. Either through a site plan or separate exhibit, clearly show any proposed deviations related to site require-
ments such as yards/setbacks, lot coverage, parking or other applicable standards. Ensure that the sepa-
rate sheet number is referenced
if it is within the plan sheet.
ii. Either through the building elevation or separate exhibit clearly show any proposed deviations re-
lated to building construction such as height, second story additions, or other applicable standards.
Response: Not applicable as property is not located within NCOA.
