WAIVER OF RIGHT TO PROTEST
CREATION OF SPECIAL IMPROVEMENT DISTRICTS
FOR:SWISSDETAIL INC.
I,the undersigned Owner of the realpropertysituatedin the County of Gallatin,Stateof
Montana,and more particularlydescribed as follows:Lot 3,Block 4 of CATTAIL CREEK
SUBDIVISION PHASE 1,[PlatJ-340],locatedin the Northwest Quarter of Section35,T.1 S.,
R.5 E.of P.M.M.,City of Bozeman,GallatinCounty,Montana.
IN CONSIDERATION of receivingfinalplan approval from the Cityof Bozeman forthe
Swiss Plaza siteplan,along with accompanying rightsand privilegesand for other valuable
consideration,the receiptof which ishereby acknowledged,and inrecognitionof the impacts to
City transportationand infrastructuresystems thatwillbe generated by the development of the
above-describedproperty,do hereby forourselves,our heirs,personalrepresentatives,successors
and assigns,waive the rightto protestthe creationof one or more SpecialImprovement Districts
(SID's)forthe following:
a.Streetimprovements to N 27thAvenue (Thomas Drive)from Sartain Streetto
Cattail Street including paving,curb/gutter,boulevard landscaping and
irrigation,sidewalk,and storm drainage.
Or to make any writtenprotestagainstthe proposed work or againstthe extentor creationof the
districts(SID's)to be assessedin response to a duly passed resolutionof intentionto createone
or more specialimprovement districtswhich would includetheabove-describedproperty.
In the event an SID is not utilizedfor the completion of these improvements,the
developer agrees to participatein an alternatefinancing method for the completion of said
improvements on a fairshare,proportionatebasisas determined by square footage of property,
taxablevaluationof the property,trafficcontributionfrom the development or a combination
thereof.
Thiswaivershallbe a covenantrunningwiththelandandshallnotexpirewiththe
dissolutionofthePropertyOwnersAssociation,providedhoweverthiswaivershallapplytothe
landshereindescribed.
Theterms,covenantsandprovisionsofthiswaivershallextendto,andbebindingupon
thesuccessors-in-interestandassignsoftheLandowner.
