In July 2020 my neighbors, the Wysocki’s, started construction on a Shed within the setbacks of Zoning
Regulations for the Gallatin County. I filed a complaint with the Compliance Department (ID#21-001) .
On 11/17/2020 a LUP (#L2021-068) was approved by Ms Fruh with Shed crossed out and Accessory Building was
used. I submitted another complaint (ID #21-036) on 12/4/2020. Soon a Variance Application (#Z2021-051 (061?)
was submitted by the Wysocki’s . A BOA hearing was convened on 5/18/2021 where the Variance Application was
denied. On 9/3/2021 a LUP (L2022-067) was approved for an Accessory Garage by Ms Oakley. Another BOA
Hearing was conducted on Nov 2021 to reverse the Garage LUP approval. The LUP for the Garage was denied by
the board.
You would think that would be the end of it. No. The Wysocki’s sued the BOA. I was kicked out of two board
meetings in the February/March 2022. Then the Wysocki’s and the BOA met with Judge Bruner where the BOA
reversed its’ November 2021 decision. I was not notified of that meeting even though the Wysocki’s and I share
the property line. Then Judge Bruner made a judgment as part of the court record. I am currently filing
paperwork to reverse Judge Bruner’s decision.
I’m asking this Ethics Board to review what has happened to me by the Wysocki’s/BOA/Planning Department
(specifically Fruh and Oakley) regarding the Shed/Accessory Building/Garage. In my opinion all parties colluded
unethically to keep the Shed within the Setbacks in violation of the Gallatin County Zoning Regulations. I request
that the BOA and the Planning Department be reprimanded so that this doesn’t happen to anyone else. I also
request that the Shed be moved or removed to stay in compliance with Zoning Regulations.
Other items the Ethics Board should be aware.
• The Wysocki’s remodeled their house from a 4 bed 3 bath dwelling to a 6 bed 5 bath dwelling without
upgrading their septic system. They simply made two of their bedrooms a weight room and a computer
room since the Zoning Regulations don’t count bathrooms only bedrooms per Cadastral. I guess a set of
dumbbells and a laptop works wonders with the Planning Department. But the septic system has not
been upgraded putting the area residents groundwater at risk.
• The Wysocki’s are conducting an Air B&B. This is in violation of Zoning Regulations. I filed a complaint on
this in Nov 2020. Too many cars are at the Wysocki Residence and in the street overnight. Plus this is
designated as R1, Single Family Dwelling.
• Chronicle Opinion page October 9, 2022 by Suzie Johnson. Suzie wrote that the “City needs to listen to
the public on zoning changes.” Apparently she is unhappy with a Frat house in her backyard where it is
zoned R1 or R2.
• Chronicle Opinion page Dec 23, 2022 by Travis Smith. He is unhappy that there is a sorority house is at 4th
and Garfield. He states that 50 – 100 people have loud music, drinking, and parties.
• Chronicle Opinion page Dec 25, 2022 by Geoffrey Poole. Apparently the “City is failing to balance the
interests of residents.” This is where a brewery and a 2,000 sq/ft drinking patio is proposed where a
“village convenience store’ is designated. And it is near Sacagawea Middle School is located.
What is happening to our community? Zoning Regulations have been written to safeguard its’ residents. And it
should be enforced. Not an obstacle to be overcome. Ethics need to be instilled in our city/county employees. I
think they are failing.
