The purpose of this email is to urge you to pass Resolution No. 5470 addressing your concern for
hazards posed by single use plastics. As you know, every Montanan has a constitutional right to a
clean and healthful environment. Conversely, the State, and every person, has a constitutional duty
to maintain and improve a clean and healthful environment for future generations. By passing
House Bill 407 during the last legislative session, the Montana Legislature striped cities and towns of
the power to fulfill their constitutional duty by addressing the environmental harms posed by single
use plastics. Having striped cities and towns of the power to address that threat, the Legislature
must now fulfill is constitutional duty to maintain and improve a clean and healthful environment by
addressing the environmental harms created by single use plastic.
By passing Resolution No. 5470, you can acknowledge the environmental harms posed by single use
plastics, your desire to address them and encourage the Legislature to address them now that it has
prevented you from fulfilling your constitutional duty to address them.
