December 12, 2022 To: Director of the Planning Department From: James Pritchard 3117 Madrona Lane Bozeman, MT 59715 RE: site Plan 22047, Little Horse Drive & Sundance Springs I object to the proposed commercial construction for the corner of Little Horse Drive and South 3rd Avenue, and I urge you to reject the proposal. First, I object to placing a tavern so close to a public middle school, just down the street. I feel strongly that these two things do not mix. There are kids on foot and on bikes all the time around here, with an elementary school nearby also. This is not a place to have impaired drivers. Secondly, the surrounding neighborhoods do not need the increased traffic that comes with a tavern. I’m very concerned about cycling safety, and at the moment the south end of town is a great place to bike. I also agree with the neighbors that the peace and quiet of the trail system of Sundance Springs would be disturbed. We walk over there quite often. Third, as my wife says, if zoning has no authority, what’s the point? There is a real hazard in property-tax-paying citizens losing faith in the zoning and planning process, when exemptions are issued indiscriminately. Fourth, the Sundance Springs Planned Unit Development (PUD) and its associated 1998 zoning should apply, and have some teeth. The proposed development violates the PUD’s covenants. Just as homeowners must follow covenants, so should commercial uses follow legal agreements. That alone is enough to reject this project plan. Additionally, the PUD’s Approved Final Plan has been misplaced—and any development must follow the Final Plan and any conditions of approval. The City of Bozeman should follow its own Bozeman Municipal Code. Site Plan 22047 should be denied. Thank you, James Pritchard Alder Creek
