Date: December 11, 2022 To: City of Bozeman Commissioners From: Board of the Sundance Springs Residential Owners Association (SSROA) RE: Development Application 22047: City of Bozeman Should Uphold the Covenants of the Sundance Springs Planned Unit Development The Board of the Sundance Springs Residential Homeowners Association (SSROA), as well as a number of members of the SSROA, have reviewed Development Application 22047. There is concern that the development, as proposed, appears to ignore important covenants established in the Sundance Springs PUDs pertaining to the parcel designated Neighborhood Commercial Lot # 2. We feel it is preferable thatthese conflicts with the covenants get resolved early enough in the planning process to avoid the costs associated with a formal appeal to the City Commission, which is likely to occur if the covenants are disregarded. The Board of the SSROA expects the City of Bozeman to abide by and enforce the covenants for the Sundance Springs Planned Unit Development (PUD) regarding, in particular, how such covenants apply to Sundance Springs Neighborhood Commercial (formerly Neighborhood Services) Lot # 2. The City is a party to thesecovenants, as noted in the Findings of Fact and Order approved by the 1990’s era Commission. We are grateful that the City is a partner with SSROA via our PUD. Thank you forupholding our covenants now and in the future. Unanimous support by the SSROA board was given to submit this letter at the December 8, 2022, Annual Meeting.
