LandowneragreestheCityhasthesolerighttocontrolthedesignandconstructionofsuch improvementsandmay includeanyoftheabovecomponentsandothersnecessarytoensure suchimprovementscomplywithaHadoptedCityinfrastructureplansandrequirements.Further. theLandownerwaivesitsrightortomakeanywrittenprotestagainstthesizeorareaorcreation ofthedistrictbeassessedinresponsetoadulypassedresolutionofintentiontocreateoneor morespecialimprovementdistrictswhichwouldincludetheabove-describedproperty. Intheeventaspecialdistrictorspecialimprovementdistrictisnotutilizedforthe completionoftheseimprovements,thedeveloperagreestoparticipateinanalternatefinancing methodforthecompletionofsaidimprovementsonafairshare,proportionatebasisas determinedbytheCityonthebasisofthesquarefootageofproperty,taxabicvaluationofthe property,trafficcontributionfromthedevelopmentoracombinationtherof. Thiswaiverismade forthebenefitofthepropertydescribedhereinshallbeacovenant runningwiththeland.
