WAIVER OF RIGHT TO PROTEST
CREATION OF SPECIAL DISTRICT OR SPECIAL IMPROVEMENT DISTRICTS
The undersigned owner of the realproperty situatedinthe County of Gallatin,Stateof Montana,
and more particularlydescribedas follows:
Catron Crossing Sub,S26,T01 S,ROS E,Block 3,Lot 4,Acres 2.12,PlatJ-662
IN CONSIDERATION of receivingapproval for SitePlan Approval
of the subjectpropertyfrom the City of Bozeman,along with accompanying rightsand privilegesand
forotherand valuableconsideration,the receiptof which ishereby acknowledged,and inrecognitionof
the impacts to includingpaving,curb/gutter,sidewalk,and storm drainage,and intersections.
which willbe caused by the development of the above-describedproperty,the owner has waived and
does hereby waive foritself,itssuccessorsand assignsforeverthe rightto protestthecreationof one or
more specialdistrictsor specialimprovement districtsforthedesign and engineering,constructionand
maintenance of the followingimprovements:

a.Streetimprovements toHonor Lane from East Valley Center Road to North 27th
Avenue includinglighting,signalization,paving,curb/gutter,sidewalk,and storm
drainage.
b.Streetimprovements to Catamount Streetfrom East Valley Center Road to North 27th
Avenue includinglighting,signalization,paving,curb/gutter,sidewalk,and storm
drainage.
c.Streetimprovements toNorth 27th Avenue from Catamount StreettoEast Valley
Center Road includinglighting,signalization,paving,curb/gutter,sidewalk,and storm
drainage,
d.Intersectionimprovements atCatamount Streetand North 27th Avenue including
lighting,signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage.
e.Intersectionimprovements atCatamount Streetand East Valley Center Road including
lighting,signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage.
f.Intersectionimprovements atHonor Lane and East Valley Center Road including
lighting,signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage.
g.Intersectionimprovements atHonor Lane and North 27th Avenue includinglighting,
signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage.
h.Intersectionimprovements atNorth 27th Avenue and East Valley Center Road
includinglighting,signalization/channelization,paving,curb/gutter,sidewalk,and storm
drainage.
Landowner agreesthe City has the solerighttocontrolthe design and constructionof such
improvements and may includeany of the above components and othersnecessarytoensure such
improvements comply with alladopted City infrastructureplans and requirements.Further,the
Landowner waives itsrightor tomake any writtenprotestagainstthe sizeor areaor creationof the
districtbe assessedinresponse to a duly passed resolutionof intentiontocreateone or more special
improvement districtswhich would includethe above-describedproperty.

In the event a specialdistrictor specialimprovement districtisnot utilizedforthe completion
oftheseimprovements,the developer agreestoparticipatein an alternatefinancingmethod forthe
completion of saidimprovements on a fairshare,proportionatebasisas detennined by the City on the
basisof the square footageofproperty,taxablevaluationof theproperty,trafficcontributionfrom the
development or a combination thereof.
This waiver ismade forthebenefitof the propertydescribedherein shallbe a covenant running
with the land.
The terms,covenants and provisionsof thiswaiver shallextend to,and be binding upon the
successors-in-interestand assignsof the Landowner.
