RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman,121 N.Rouse Avenue,Bozeman,MT 59715,a
Municipal Corporationof theStateofMontana,theGRANTOR,does hereby releaseand reconvey
the followingdescribedeasement unto Edward Balian with a mailing addressof PO Box 3403,
Sarasota,FL 34230,and L&S Properties,LLC with a mailing addressof257 Heidi Lane,Belgrade,
MT 59714,theGRANTEE,as follows:
WITNESSETH
WHEREAS the Grantor isthe legalrecordtitleholder of a 30-footpublicutilityeasement
situatedbetween the north lineof Lot 3 and the south lineof Lot 4,Block 5,Flanders Creek
Subdivision,Cityof Bozeman,[PlatJ-434],GallatinCounty,Montana.
WHEREAS theabove 30-footpublicutilityeasement was grantedby thefilingoftheplatof
FlandersCreek Subdivision,[PlatJ-434],on July 19,2006 asDocument Number 2235246,records
of theofficeof the Clerk and Recorder,GallatinCounty,Montana.
WHEREAS the installationof utilityinfrastructurehas been completed without having to
occupy theportionof saideasement thatliesbetween thenorthlineof Lot 3 and thesouthlineofLot
4,Block 5,which by thisreferenceismade a partofthisdocument.The terminationof saidportion
of the30-foot-widepublicutilityeasement willnot adverselyimpact the Grantor'sinterests.
WHEREFORE,the Grantor does hereby releaseand reconvey toEdward Balian and,L&S
Properties,LLC the 30-foot-widepublicutilityeasement as being terminated,togetherwith any
right,title,or interestthattheGrantormay have insaidpublicutilityeasement.The remainingpublic
utilityeasements locatedalong theperimetersof saidLots 3 and 4,Block 5,shallremain intact.
