HomeMy WebLinkAbout22- Waiver of Right to Protest Creation of SID - Nahorniak Commons Site Plan2788041 RETURN RECORDED DOCUMENT TO:11 1 IH15 City of Bozeman Department of Community Development P.O.Box 1230 Bozeman,MT 59771 WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL IMPROVEMENT DISTRICTS FOR:5170 Durston Rd,Smith Subdivision I,the undersigned Owner of the real property situatedin the County of Gallatin,State of Montana,and more particularlydescribedas follows: THE PROPERTY DESCRIBED IN DOCUMENT NO.2602650,AND BEING A PART OF TRACT 6 AND TRACT 7,SMITH SUBDIVISION,LOCATED IN NW 1/4 OF SECTION 11,T.2 S.,R.5 E.OF P.M.M.,CITY OF BOZEMAN, MONTANA IN CONSIDERATION of receiving siteplan approval from the City of Bozeman for the Nahorniak Commons Site Plan,along with accompanying rightsand privilegesand for other valuable consideration,the receiptof which is hereby acknowledged,and in recognitionof the impacts to City transportationand infrastructuresystems that will be generated by the development of the above-described property,do hereby for ourselves,our heirs,personal representatives,successorsand assigns,waive the rightto protestthe creationof one or more specialimprovement districts(SID's)forthe following: 1.Streetimprovements to Durston Road between Fowler Ave and 19thAve including lighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. 2.Intersectionimprovements atDurston Road and Fowler Ave includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. 3.Intersectionimprovements atDurston Road and 19thAve includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. 4.Intersectionimprovements atDurston Road and North 27th Ave includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. Or to make any writtenprotestagainstthe proposed work or againstthe extentor creationof the districts(SID's)to be assessedin response to a duly passed resolutionof intentionto createone ormore specialimprovement districtswhich would includetheabove-describedproperty. In the event an SID isnot utilizedfor the completion of these improvements,the developer agrees to participatein an alternatefinancingmethod forthe completion of saidimprovements on a fair share,proportionate basis as determined by square footage of property,taxable valuationoftheproperty,trafficcontributionfrom the development or a combination thereof. This waiver shallbe a covenant running with the land and shallnot expirewith the dissolutionof the limited liabilitycompany,provided however this waiver shallapply to the lands herein described.
