Dear Commissioners and members of the Community Development Board:
I am writing to ask that the public comment period on Site Plan 22047 be paused until
such time as the City Attorney's Office has made a determination as to the zoning thatapplies to the site. Currently, the planning department is not able to identify the
zoning that applies to the site under the PUD that governs the site, which was created
and approved by the City Commission in 1996.
My neighbors have requested that the Planning Department delay the comment
period several times, but the comment period was initiated and will now expire in just
two weeks.
We have received the following instructions from the planning department regarding
public comment:
"Please note that the department can only consider factual information or substantivediscrepancies in submitted application materials. I would encourage you to familiarize
yourself with the development code and use it as your basis for making public
comments. Provide specific and demonstrable comments on how you believe the
applicant is not meeting the city required codes. In general, broad generalizedstatements about concerns or dislike of the proposal without evidence is more difficult
for the department to evaluate if it isn’t tied to a specific finding or code requirement."
I would like to make an informed public comment about the site plan, but I can'tcomment on if or how the proposed development complies with city development
code when the City Attorney, at the request of the planning department, has not yet
identified the applicable zoning.
I would ask that the public comment period to be extended to 15 days past the date
that the City Attorney's determination of applicable zoning has been disseminated to
the public. I am hopeful that the Commission and Community Development Board
will be able to help fulfill my request.

make informed public comment.
