MUTUAL ACCESS EASEMENT AND AGREEMENT
This Easement and Agreement isestablishedthis 1.day of 5th ,2033,by
Evergreen Business Park,Inc.,of 6529 Jackson Creek Road,Bozeman,Montana 59715,and
Nikles Business Park LLC,of 4203 Arrowwood Drive,Billings,Montana,59106.
RECITALS:
WHEREAS,Evergreen Business Park,Inc.istherecordowner ("Owner")ofallthosecommon
open space areaswithin Evergreen Business Park Subdivision,includingEvergreen Drive,a
privatestreetdedicatedto publicuse;and
WHEREAS,Nikles Business Park LLC isthe recordowner ("Owner")of Lot 3A ofAmended
McChesney IndustrialPark Subdivision;and
and
WHEREAS,the Owners have determined thatitis in theirbest intereststo establisha mutual
accesseasement forthedevelopment of the lotsdescribedabove;
NOW,THEREFORE,a mutual access easement fora common driveway and ingressand egress
is hereby established.The easement is more particularlydescribed on the attached Exhibit
"EXHIBIT OF 30 FOOT WIDE ACCESS AND UTILITY EASEMENT"which by this
referenceismade a parthereof.
THAT thiscommon mutual access easement shallbe a perpetualeasement and shallbe superior
to and paramount to the rightsof any of the subsequent owners of said propertiesand the
respectiveservientestatesso created.The Owners furtherstatethatthiseasement isa covenant
that shallrun with the land,and shallbe for the benefitof and inure to the Owners,their
successorsand assigns,theiragents,employees,tenants,and guestsof tenants,and shallburden
theirrespectiveparcels,perpetually.
THAT the subsequent owners and their heirs and assigns shall be responsible for the
maintenance and repairof theirrespectiveportionsof the shared access,includingthe street
approach,full length of Evergreen Drive,and common open space areas.Said financial
responsibilityof Lot 3A Amended McChesney IndustrialPark Subdivision shall be in the
amount equal to five percent (5%)of the totalannual amount invoiced to the owners of
Evergreen Business Park,Inc.,and due and payable upon invoice issued by the Corporate
Treasurerof Evergreen Business Park,Inc.
THAT each subsequent owner and theirheirsand assigns shallhold the other party harmless
from any liabilityresultingfrom the use of the mutual access for ingressand egress to their
respectiveproperties.
THAT the mutual access easement shall remain free and clear at all times from all
encumbrances.
The Owners have executed thismutual access easement and agreement on the day and
year firstwrittenabove.
