ThisgrantincludestherightoftheGRANTEE,itssuccessors,permittees,licensees,andassigns anditsandtheiragentsandemployees,toenteratalltimesupontheabove-describedlandby usingexistingroadsortrailsorotherwiseby aroutecausingtheleastdamageandinconvenience totheGRANTOR(S)inordertosurveyandestablishtherouteandlocationoftheeasementand thepipelineandto: (1)Construct,operate,patrolrepair,substitute,remove,enlarge,replace,andmaintainthe pipeline,services,connections,accessoriesandappurtènances; (2)Trim,remove,destroy,orotherwisecontrolanytreesand brushinsideoroutsidethe boundariesoftheeasementwhichmay,intheopinionoftheGRANTEE,interfereor threatentointerferewithorbehazardoustotheconstruction,operationandmaintenance ofthepipeline; (3)Gradethelandsubjecttothiseasementandextendthecutsandfillsofthisgradinginto andonthelandadjacenttothatwhichissubjecttothiseasementtotheextentGRANTEE may findreasonablynecessary;and (4)SupportthepipelineacrossravinesandwatercourseswithstructureswhichGRANTEE deemsnecessary. THE GRANTEE AGREES: (1)That,inconnectionwiththeconstruction,operating,patrolling,repairing,substituting, removing,enlarging,replacing,andmaintainingofsaidstormsewerpipeline(s),itwill repairorreplace,atitssoleexpense,orpaytoGRANTOR(S)thereasonablevalueofany damagestogrowingcrops,existmgfences,ditchesandotherappurtenancesofsaidland thatmay bedisturbedbyitsoperation. (2)That,duringoperationsinvolvingexcavation,itwillremovethetopsoilfromthetrenched areatoa depthofonefoot,ortothefulldepthofthetopsoil,whicheverisless,and stockpilesaidtopsoilforreplacementoverthetrench.Itwillremovefromthesiteany largerocksorsurplusexcavatingmaterialoranydebristhatmay havebeenexposedby theexcavationandremainsafterbackfillingiscompleted.And,itwillleavethefmished surfaceinsubstantiallythesameconditionasexistedpriortothebeginningofoperations exceptthatthesurfaceofbackfilledareasmay be moundedsufficientlytopreventthe formationofdepressionsafterfinalsettlementhastakenplace. THE GRANTOR(S)AGREES: (l)Atnotimewilltheybuild,construct,erectormaintainanypermanentstructurewithinthe boundariesofsaideasementwithoutthepriorwrittenconsentofGRANTEE. (2)Atno timewilltheymodifythefinishedgradeofthelandoverthepipelinebyremovalof existingsoilorby placementoffillmaterialwithintheboundariesofsaideasement withoutthepriorwrittenconsentoftheGRANTEE. (3)Thatwherethesubjectimprovementsarenotlocatedunderimprovedpublicorprivate streetsor otherprovidedaccess,a 12 footwide all-weatheraccessroadmay be constructedwithintheeasementwhereattheCity'sdiscretionsuchaccessisrequiredfor operationandmaintenancepurposes. (4)The GRANTOR(S)warrantsthattheyarelawfullyseizedand possessedof thereal propertydescribedabove,thattheyhavea lawfulrighttoconveytheproperty,oranypart ofit,andthattheywillforeverdefendthetitletothispropertyagainsttheclaimsofall persons.
