Bozeman City CommissionANDCommunity Development BoardCity of Bozeman Dear Commissioners and members of the Community Development Board: I am writing to ask that the public comment period on Site Plan 22047 bepaused until such time as the City Attorney's Office has made a determinationas to the zoning that applies to the site. Currently, the planningdepartment is not able to identify the zoning that applies to the site underthe PUD that governs the site, which was created and approved by the CityCommission in 1996. My neighbors have requested that the Planning Department delay the commentperiod several times, but the comment period was initiated and will nowexpire in just two weeks. We have received the following instructions from the planning departmentregarding public comment: "Please note that the department can only consider factual information orsubstantive discrepancies in submitted application materials. I wouldencourage you to familiarize yourself with the development code and use it asyour basis for making public comments. Provide specific and demonstrablecomments on how you believe the applicant is not meeting the city requiredcodes. In general, broad generalized statements about concerns or dislike ofthe proposal without evidence is more difficult for the department toevaluate if it isn’t tied to a specific finding or code requirement." I would like to make an informed public comment about the site plan, but Ican't comment on if or how the proposed development complies with citydevelopment code when the City Attorney, at the request of the planningdepartment, has not yet identified the applicable zoning. I would ask that the public comment period to be extended to 15 days past thedate that the City Attorney's determination of applicable zoning has beendisseminated to the public. I am hopeful that the Commission and CommunityDevelopment Board will be able to help fulfill my request.
