Bozeman City CommissionANDCommunity Development BoardCity of Bozeman Dear Commissioners and members of the Community DevelopmentBoard: I am writing to ask that the public comment period on Site Plan22047 be paused until such time as the City Attorney's Officehas made a determination as to the zoning that applies to thesite. Currently, the planning department is not able toidentify the zoning that applies to the site under the PUD thatgoverns the site, which was created and approved by the CityCommission in 1996. My neighbors have requested that the Planning Department delaythe comment period several times, but the comment period wasinitiated and will now expire in just two weeks. We have received the following instructions from the planningdepartment regarding public comment: "Please note that the department can only consider factualinformation or substantive discrepancies in submittedapplication materials. I would encourage you to familiarizeyourself with the development code and use it as your basis formaking public comments. Provide specific and demonstrablecomments on how you believe the applicant is not meeting thecity required codes. In general, broad generalized statementsabout concerns or dislike of the proposal without evidence ismore difficult for the department to evaluate if it isn’t tiedto a specific finding or code requirement." I would like to make an informed public comment about the siteplan, but I can't comment on if or how the proposed developmentcomplies with city development code when the City Attorney, atthe request of the planning department, has not yet identifiedthe applicable zoning. I would ask that the public comment period to be extended to 15days past the date that the City Attorney's determination ofapplicable zoning has been disseminated to the public. I amhopeful that the Commission and Community Development Boardwill be able to help fulfill my request.
