WAIVER OF RIGHT TO PROTEST
CREATION OF SPECIAL IMPROVEMENT DISTRICTS
FOR NEXUS POINT
The undersigned owner of therealpropertysituatedintheCounty of Gallatin,Stateof
Montana,and more particularlydescribedasfollows:
Lot 1 Minor Sub 235,situatedintheNortheast%of Section23,Township 2 South,Range 5
East,P.M.M.City of Bozeman,GallatinCounty Montana.
The above describedtractof land istobe known and designatedas Nexus Point,City of
Bozeman,GallatinCounty,Montana;and the landsincludedin allstreets,avenues,alleysand
parks or publicsquaresshown on saidplatare hereby grantedand donated totheCity of
Bozeman forthepublicuse and enjoyment.Unless specificallylistedherein,the landsincluded
in allstreets,avenues,alleys,and parks or publicsquaresdedicatedto the publicareacceptedfor
publicuse,but the City acceptsno responsibilityformaintainingthe same.The owners agree
thatthe City has no obligationto maintainthe landsincludedinallstreets,avenues,alleysand
parks or publicsquaredhereby dedicatedtopublicuse.The lands includedinallstreets,
avenues,alleysand parks or publicsquaresdedicatedtothepublicforwhich the cityaccepts
responsibilityformaintenance.
IN CONSIDERATION of receivingapprovalforMASTER SITE PLAN AND SITE
PLAN of the subjectpropertyfrom the City of Bozeman,along with accompanying rightsand
privilegesand forotherand valuableconsideration,the receiptof which ishereby acknowledged,
in recognitionoftheimpacts thatwillbe generatedby the development of the above-described
propertyatNexus Point,have waived and do hereby forourselves,our heirs,personal
representatives,successorsand assigns,the rightto protestthe creationof one or more special
improvement districtsfortheconstructionof:
a.Streetimprovements to Stucky Road includingpaying,curb/gutter,sidewalk,and
storm drainage
b.Streetimprovements to Graf Streetincludingpaying,curb/gutter,sidewalk,and
storm drainage
c.Intersectionimprovements to Stucky Road and South 19 Avenue

or to make any writtenprotestagainstthe proposed work or againstthe extentor creationof the
districtsto be assessedin response to a duly passed resolutionof intentionto createone or more
specialimprovement districtswhich would includethe above-describedproperty.
In the event an SID is not utilizedfor the completion of these improvements,the
developer agrees to participatein an alternatefinancing method for the completion of said
improvements on a fairshare,proportionatebasisas determined by square footage of property,
taxable valuationof the property,trafficcontributionfrom the development or a combination
thereof.
This waiver shallbe a covenant running with the land and shallnot expire with the
dissolutionof the limited partnership,provided however thiswaiver shallapply to the lands
herein described.
The terms,covenants and provisionsof the Waiver shallextend to,and be binding upon
the successors-in-interestand assignsof the partieshereto.
