Blackwood Land Fund,LLC,a Delaware limitedliabilitycompany,of 140 Village Crossing
Way,Unit 3B,Bozeman,Montana 59715,the GRANTOR,in considerationof one dollarand
other good and valuableconsideration,receiptof which isacknowledged,does hereby grant to
City of Bozeman,121 North Rouse Avenue,P.O.Box 1230,Bozeman,MT 59771-1230,a
Municipal Corporation of the State of Montana,GRANTEE,its successors and assigns,a
perpetualpedestrianaccess easement for the use of the public,in,through and acrossa stripof
land 10 feetwide situatedin GallatinCounty,Montana,to be locatedon the followingdescribed
realproperty:
Lot 1,Block 1,BLACKWOOD GROVES SUBDIVISION PHASES 1 AND 9,City of
Bozeman,and locatedin the SW 1/4 of Section 24,T.2 S.,R.5 E.of P.M.M.,Gallatin
County,Montana.J-714
The easement ismore particularlyshown and dimensioned on the attachedExhibit A,which by
thisreferenceismade a partofthisdocument.
The GRANTOR statesthat itpossesses the real property described above and that he has a
lawfulrightto grantan easement thereon.
The GRANTOR furtheragrees thatthe GRANTEE may peaceably hold and enjoy the rightsand
privilegeshereingrantedwithout any interruptionby theGRANTOR.
The terms,covenants,and provisionsof thiseasement shallextend to and be binding upon the
heirs,executors,administrators,personalrepresentatives,successors,and assignsof the parties
hereto.
