Bozeman City CommissionANDCommunity Development BoardCity of Bozeman Dear Commissioners and members of the Community Development Board: I am writing to ask that the public comment period on Site Plan22047 be paused until such time as the City Attorney's Office hasmade a determination as to the zoning that applies to the site. Currently, the planning department is not able to identify thezoning that applies to the site under the PUD that governs thesite, which was created and approved by the City Commission in1996. My neighbors have requested that the Planning Department delay thecomment period several times, but the comment period was initiatedand will now expire in just two weeks. We have received the following instructions from the planningdepartment regarding public comment: "Please note that the department can only consider factualinformation or substantive discrepancies in submitted applicationmaterials. I would encourage you to familiarize yourself with thedevelopment code and use it as your basis for making publiccomments. Provide specific and demonstrable comments on how youbelieve the applicant is not meeting the city required codes. Ingeneral, broad generalized statements about concerns or dislike ofthe proposal without evidence is more difficult for the departmentto evaluate if it isn’t tied to a specific finding or coderequirement." I would like to make an informed public comment about the siteplan, but I can't comment on if or how the proposed developmentcomplies with city development code when the City Attorney, at therequest of the planning department, has not yet identified theapplicable zoning. I would ask that the public comment period to be extended to 15days past the date that the City Attorney's determination ofapplicable zoning has been disseminated to the public. I amhopeful that the Commission and Community Development Board will beable to help fulfill my request.
