RE: Response to Addison Place Condos Concept Plan Review Comments (#20224)
Dear Ms. Paz-Solis:
This letter is to provide a narrative response to the Engineering Review provided on November 3,
2021. Responses to comments are in italics below.
Easements
1. The applicant may contact the Engineering Department to receive a copy of the required
easement templates
This is noted.
2. BMC 38.410.060 (B.2) - Easements - The applicant must provide a ten (10) foot utility easement
(power, gas, communication, etc.) along the development’s property frontage prior to Site Plan
approval.
This is noted. A 10’ Utility easement has been provided across the lot frontage on Sartain Street
and Thomas Drive. A draft of the easement document has been provided with this submittal.
3. BMC 38.410.060 (A.1) - In subdivisions, all easements must be described, dimensioned and
shown on the final plat in their true and correct location. The applicant must provide a release
re-conveyance documents for an easement (power, gas, etc.) that will no longer be needed.
This is noted. No easement are proposed to be abandoned. A plat will not be filed with the
project.
4. BMC 38.410.060 - Easements - The applicant must provide a public drainage easement for any
stormwater features on site that will accept runoff from the public right-of-way prior to Site Plan
approval.
This is noted. A draft of the stormwater easement has been included with the site plan
submittal.
5. BMC 38.400.060 - Street Improvement Standard - Thomas Drive is classified as a
“collector” street which requires 90 feet of right-of-way (ROW). 45 feet of ROW is required
from the centerline of Thomas Drive to the edge of applicant’s property. The applicant would
need to provide their respective portion of ROW to the City. Development of the Site requires
the requires the requires the improvement of the street along the Site’s frontage to City
standards, which includes proper drainage, dedication of right-of-way (ROW), pavement,
detached sidewalks, landscaped and irrigated boulevard strip, trees within the boulevard, curb
and gutter along with proper access points into the site.
This is noted. The proposed expansion of the west half of Thomas Drive is shown on the site
plan set. The stormwater design report and site improvements are designed to meet this section
of the Bozeman Municipal Code.
Paybacks
6. The subject property is located within the N 19th and Baxter Intersection Payback District. The applicant
is required to pay a proportionate share of the construction costs prior to Site Plan approval. Please contact
Marcy Yeykal myeykal@bozeman.net for exact amount determination/payment.
This is noted and understood. The applicant will pay the necessary payback district fees prior
to approval.
Water Rights
7. BMC 38.410.130 (A.1) - Water Rights - The applicant must contact Griffin Nielsen with the City
Engineering Department to obtain a determination of cash-in-lieu of water rights (CILWR). CILWR
must be paid prior to site plan approval.
This is noted. Griffin Nielsen indicated that the CILWR for the project was provided with the
underlying subdivision. The finalized amount will be paid prior to site plan approval.
Water and Wastewater
1. BMC 38.410.070 and DSSP Section V.A and B - Prior to a determination of adequacy the applicant
must provide an estimate of the peak-hour sanitary sewer demand as well as the average and max day
demands of domestic water usage for the proposed site development. The estimates must be certified by
a professional engineer.
A water and sewer design report has been provided with the submittal. The report is stamped
by a professional engineer and meets the requirements of this section.
2. DSSP Section V.A - A water design report must be prepared by a professional engineer for the proposed
project. The water distribution system must be designed to meet the maximum day demand plus fire
flow and the peak hour demand.

3. DSSP Section V.A (6.f)- All service connections shall be uniform size from the service line tap to the
building structure or structures unless otherwise approved or required by the Water Superintendent.
This is noted. The services are planned as such.
4. DSSP Section V (B.11) - Sanitary Sewer Services - The minimum diameter of a service is 4-inch.
Services shall connect to the main with in-line gasketed wyes. The service line stub, from the main to
the property line or easement line, shall be installed with a maximum slope of ½-inch per foot. The
minimum slope of a 4-inch service line stub is ¼- inch per foot. The minimum slope of a 6-inch service
line stub is ⅛-inch per foot. Sewer service line stubs will typically be installed 15-feet from the
downstream lot line. Services are to be installed perpendicular to the main.
This is noted. The planned sanitary sewer service will meet the requirements of this section.
5. DSSP Fire Service Line Standard - The applicant must prepare plans and specifications for any fire
service line in accordance with the City’s Fire Service Line Policy. The plans must be prepared by a
Professional Engineer and be provided to and approved by the City Engineer prior to initiation of
construction of the fire service or fire protection system. The applicant must also provide Professional
Engineering services for construction inspection, post-construction certification and preparation of mylar
record drawings. Fire service plans, and domestic services 4” or larger, must be a standalone submittal,
separate from the site plan submittal. City of Bozeman applications for service must be completed by the
applicant.
This is noted. A fire service plan for the building will be prepared upon adequacy of the site
plan application.
Transportation
1. BMC 38.220.080.A (2.g) - Traffic Generation - The applicant must submit a peak hour trip generation
value to the City to determine whether a traffic impact study is required.
This is noted. Peak hour trip generation numbers have been submitted to the City and a waiver
from the TIS has been requested.
Stormwater
1. DSSP Section II (A.4) - Water Quality - The applicant must include a drainage plan with post-
construction storm water management controls that are designed to infiltrate, evapotranspire, and/or
capture for reuse the post-construction runoff generated from the first 0.5 inches of rainfall from a 24-
hour storm preceded by 48 hours of no measurable precipitation. For projects that cannot meet 100% of
the runoff reduction requirement, the remainder of the runoff from the first 0.5 inches of rainfall must be
either: a. Treated onsite using post-construction storm water management control(s) expected to remove
80 percent total suspended solids (TSS); b. Managed offsite within the same sub-watershed using post-
construction storm water management control(s) that are designed to infiltrate, evapotranspire, and/or
capture for reuse; or c. Treated offsite within the same subwatershed using post-construction storm water
management control(s) expected to remove 80 percent TSS.
This is noted. The site plan grading plans will use retention ponds for stormwater management.
The City’s design standards are such that this requirement is met with retention designs.
2. DSSP Section II.C - Water Quantity - The applicant must provide on-site detention with release rates
limited to predevelopment runoff rates. Retention ponds must be sized based on a 10- year, 2-hour storm
intensity.
This is noted. Detention is not planned with this project.
3. Montana Post-Construction Storm Water BMP Design Guidance Manual - Seasonal High
Groundwater - The proposed project is located in an area that is known to have seasonally high
groundwater. The applicant must demonstrate that seasonal high groundwater will not impact the
function or maintenance of the proposed facilities. Industry guidance recommends a three- foot minimum
separation from the bottom of the proposed facility to the underlying groundwater table.
This is noted. Groundwater Monitoring information is included with the stormwater design
report.
Conditions of Approval
1. City of Bozeman Resolution 5076, Policy 1 - The applicant must provide and file with the
County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special
Improvement Districts (SID’s) on City standard form for the following:
a. Street improvements to Sartain Street between Hoover Way and 19th Avenue including
lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage.
b. Street improvements to 27th Avenue between Cattail Street and Baxter Lane including
lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage.
c. Street improvements to Thomas Drive between Cattail Street and Baxter Lane including
lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage.
d. Street improvements to Buckrake Avenue between Sartain Street and Baxter Lane
including lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage.
e. Intersection improvements at 27th Avenue and Baxter Lane including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
f. Intersection improvements at 27th Avenue and Sartain Street including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
g. Intersection improvements at Thomas Drive and Sartain Street including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
h. Intersection improvements at 27th Avenue and Cattail Street including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
i. Intersection improvements to Buckrake Avenue and Sartain Street including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
j. Intersection improvements to Buckrake Avenue and Baxter Lane including
lighting, signalization/channelization, paving, curb/gutter, sidewalk, and storm
drainage.
k. Intersection improvements to 19th Avenue and Sartain Street including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.

Civil/Structural Engineering and Surveying
The document filed must specify that in the event an SID is not utilized for the completion of
these improvements, the developer agrees to participate in an alternate financing method for
the completion of the improvements on a fair share, proportionate basis as determined by
square footage of property, taxable valuation of the property, traffic contribution from the
development, or a combination thereof. The applicant must provide a copy of the filed SID
waiver prior to site plan approval.
This is noted. A draft of the Waiver of SIDS is included wit the submittal. The document will
be signed and filed prior to site plan approval.
