SARTAIN STREET
William H. Louis,Mardie A. Louis,and Latigo Investments, LLC, collectively, GRANTORS with
address of 1242 Thomas Drive, Bozeman, MT 59718, for valuable consideration, receipt of which
is hereby acknowledged, grant to the City of Bozeman, a municipal corporation of the State of
Montana, with offices at 411 East Main, P O. Box 1230, Bozeman, Montana 59771-1230,
GRANTEE, a perpetual street and utility easement for the use of the public,over,under, and across,
a strip of land situated in Gallatin County, Montana, 60.00 feet wide to be located on the following
described real property:
Tract A:
Lots 4 and 5 of Baxter Land Subdivision, located in the W '/Z B 1/7, SW 1/4 of Section 35,
Township 1 South, Range S East, P.M.M., thereof on file and of record in the office of the
County Clerk and Recorder of Gallatin County, Montana,
Tract B:
The W '/2 E 'h SE 1/4 SW 1/4 of Section 35,Township 1 South,Range 5 East, P.M.M , Gallatin
County,Montana,Deed Reference in Film 11,page 1858,records of Gallatin County,Montana.
EXCEPTING THEREFROM a tract of land in the SW 1/4 of Section 35, Township 1 South,
Range 5 East,M.P.M., Gallatin Count, Montana, described as follows:Beginning at the South
one quarter corner of said Section 35, thence South 89016'00" West on and along the South line
of said Section 35, a distance of 330.52 feet to the true point of beginning; thence South
8901600"West on and along Said South line a distance of 165.26 feet;thence North Oa05'30"
West a distance of 527.17 feet; thence North 890 16'00" East a distance of 165.26 feet; thence
South 0405'30" East a distance of 527.17 feet to the true point ofbeginning. Deed Reference in
Film 17, page 1593, records of Gallatin County, Montana.
The easement shall be a road easement and right of way for access, ingress, egress, and utilities, and
shall rvn west from Grantors' easternmost property line of Tract A, to the east property line of Tract
B. Said easement shall be 60 feet in width, and shall be over, across, and under Tract A described
above, with 30 feet being along the south boundary line of Lot 4 of Baxter Lane Subdivision,and 30
feet being along the north boundary line of Lot 5 of Baxter Land Subdivision. The Easement shall be
for the benefit of the adjacent real property described as Tract B above, and is more particularly
shown and described on the attached EASEMENT EX141BIT which by this reference is made a part
hereof.
The GRANTORS state that they possesses the real property described above and that he has a lawful
right to grant an easement thereon.
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTORS.

The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs,
