Landowner agreestheCityhas thesolerighttocontrolthedesignand constructionof such improvements and may includeany of theabove components and othersnecessarytoensuresuch improvements comply with alladoptedCityinfrastructureplansand requirements.Further,the Landowner waives itsrightortomake any writtenprotestagainstthesizeorareaor creationof the districtbe assessedinresponsetoa duly passed resolutionof intentiontocreateone ormore special improvement districtswhich would includetheabove-describedproperty. SIDWaiver Page2of3 Intheeventa specialdistrictorspecialimprovement districtisnot utilizedforthecompletion of theseimprovements,thedeveloperagreestoparticipateinan alternatefinancingmethod forthe completionof saidimprovements on a fairshare,proportionatebasisasdeterminedby theCityon the basisofthesquarefootageof property,taxablevaluationof theproperty,trafficcontributionfrom the development or a combination thereof. This waiver ismade forthebenefitofthepropertydescribedhereinshallbe a covenantrunning with the land. The terms,covenantsand provisionsof thiswaiver shallextend to,and be bindingupon the successors-in-interestand assignsof theLandowner.
