B.INTERSECTION IMPROVEMENTS TO CAMPBELL ROAD AND SPRINGHILL ROAD INCLUDING LIGHTING,SIGNALIZATION/CHANNELIZATION,PAVING, CURB/GUTTER,SIDEWALK,AND STORM DRAINAGE. Landowner agreesthe Cityhas thesolerighttocontrolthedesignand constructionof such improvements and may includeany oftheabove components and othersnecessarytoensuresuch improvements comply with alladoptedCityinfrastructureplansand requirements.Further,the Landowner waives itsrightor tomake any writtenprotestagainstthesizeorareaor creationof the districtbe assessedinresponsetoa dulypassed resolutionof intentiontocreateone ormore special improvement districtswhich would includetheabove-describedproperty. SIDWaiver Page2of3 In theeventa specialdistrictor specialimprovement districtisnotutilizedforthecompletion oftheseimprovements,thedeveloperagreestoparticipateinan alternatefinancingmethod forthe completionof saidimprovements on a fairshare,proportionatebasisas determinedby theCityon the basisof thesquarefootageofproperty,taxablevaluationof theproperty,trafficcontributionfrom the development ora combinationthereof. This waiver ismade forthebenefitof thepropertydescribedhereinshallbe a covenantrunning with theland. The terms,covenantsand provisionsof thiswaiver shallextendto,and be bindingupon the successors-in-interestand assignsofthe Landowner.
