WAIVER OF RIGHT TO PROTEST
CREATION OF SPECIAL DISTRICT OR SPECIAL IMPROVEMENT DISTRICTS
The undersignedowner oftherealpropertysituatedintheCounty of Gallatin,Stateof Montana,
and more particularlydescribedasfollows:

IN CONSIDERATION of receivingapprovalfor
of the subjectpropertyfrom theCityof Bozeman,alongwith accompanying rightsand privilegesand
forotherand valuableconsideration,thereceiptof which ishereby acknowledged,and inrecognitionof
theimpactsto CAMPBELL AND SPRINGHILL ROAD
which willbe caused by thedevelopment of theabove-describedproperty,theowner has waived and
does herebywaive foritself,itssuccessorsand assignsforevertherighttoprotestthecreationof one or
more specialdistrictsor specialimprovement districtsforthedesignand engineering,constructionand
maintenance of thefollowingimprovements:

A.STREET IMPROVMENTS TO CAMPBELL ROAD INCLUDING LIGHTING,
SIGNALIZATION,PAVING,CURB/GUTTER,SIDEWALK,AND STORM
DRAINAGE.
B.INTERSECTION IMPROVEMENTS TO CAMPBELL ROAD AND SPRINGHILL
ROAD INCLUDING LIGHTING,SIGNALIZATION/CHANNELIZATION,PAVING,
CURB/GUTTER,SIDEWALK,AND STORM DRAINAGE.
Landowner agreesthe Cityhas thesolerighttocontrolthedesignand constructionof such
improvements and may includeany oftheabove components and othersnecessarytoensuresuch
improvements comply with alladoptedCityinfrastructureplansand requirements.Further,the
Landowner waives itsrightor tomake any writtenprotestagainstthesizeorareaor creationof the
districtbe assessedinresponsetoa dulypassed resolutionof intentiontocreateone ormore special
improvement districtswhich would includetheabove-describedproperty.

In theeventa specialdistrictor specialimprovement districtisnotutilizedforthecompletion
oftheseimprovements,thedeveloperagreestoparticipateinan alternatefinancingmethod forthe
completionof saidimprovements on a fairshare,proportionatebasisas determinedby theCityon the
basisof thesquarefootageofproperty,taxablevaluationof theproperty,trafficcontributionfrom the
development ora combinationthereof.
This waiver ismade forthebenefitof thepropertydescribedhereinshallbe a covenantrunning
with theland.
The terms,covenantsand provisionsof thiswaiver shallextendto,and be bindingupon the
successors-in-interestand assignsofthe Landowner.
