COMMISSION RESOLUTION NO. 3187 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE PURCHASE OF ROAD OIL AND SUNDRY CONSTRUCTION MA TERIALS FROM THE MONT ANA DEPARTMENT OF TRANSPORTATION DURING FISCAL YEAR 1997.1998 ON AN AS NEEDED BASIS. WHEREAS, the City of Bozeman will have need, during the Fiscal Year July 1, 1997 through June 30, 1998, for road oils for use in repairing streets and sealing certain sections of existing pavement within the City and sundry construction material; and WHEREAS, the City of Bozeman, in the past, has purchased, during the course of a year, sundry construction materials from the Montana Department of Transportation; and WHEREAS, the Montana Department of Transportation does have storage facilities and normally does have quantities of the required types of oils stored in Bozeman from which it can supply the quantities needed by the City of Bozeman; and WHEREAS, Section 7-5-4303(2), Montana Code Annotated, provides that local governmental entities may purchase supplies and equipment from another governmental entity without going through the competitive bidding process when the same can be purchased at a substantial savings; and WHEREAS, road oil and sundry construction material can be purchased from the Montana Department of Transportation at a substantial savings. NOW, THEREFORE, BE IT RESOLVED that an express need does exist for the procurement of road oils and sundry construction materials by the City of Bozeman; therefore, the City Manager is hereby authorized to purchase from the Montana Department of Transportation from time to time during the Fiscal Year July 1, 1997 through June 30, 1998, as needed, sundry construction material and approximately twenty-five thousand (25,000) gallons of road oils, for repair and sealing of existing pavements, from its stock in storage in Bozeman, and such road oils and material to be purchased at cost plus normal handling charges. Said purchases are to be made from "Gas Tax Funds." PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 16th day of June 1997.
