IN CONSIDERATION of receivingapprovalfor siteplan
of thesubjectpropertyfrom theCityof Bozeman,alongwith accompanying rightsand privilegesand
forotherand valuableconsideration.thereceiptof which ishereby acknowledged.and inrecognitionof
theimpactsto Citytransportationand infrastructuresystems
which willbe caused by thedevelopment of theabove-describedproperty.theowner haswaived and
does hereby waive foritself.itssuccessorsand assignsforevertherighttoprotestthecreationof one or
more specialdistrictsorspecialimprovement districtsforthedesignand engineering.constructionand
maintenance of thefollowingimprovements:

curb and gutter,sidewalk,and storm drainage.
b.Intersectionimprovements atNikles Drive and North 7thAvenue includinglighting,
signalization/channelization,paving,curb and gutter,sidewalk,and storm drainage.
c.Intersectionimprovements atWest GriffinDrive and North 7thAvenue including
lighting,signalization/channelization,paving,curb and gutter,sidewalk,and storm
drainage.
d.Intersectionimprovements atNiklesDrive and GilkersonDrive includinglighting,
signalization/channelization,paving,curb and gutter,sidewalk,and storm drainage.
e.Intersectionimprovements atGilkersonDrive and GriffinDrive includinglighting,
signalization/channelization,paving,curb and gutter,sidewalk,and storm drainage.
Landowner agreestheCityhas thesolerighttocontrolthedesignand constructionof such
improvements and may includeany of theabove components and othersnecessarytoensuresuch
improvements comply withalladopted City infrastructureplansand requirements.Further.the
Landowner waives itsrightor tomake any writtenprotestagainstthe sizeor areaorcreationofthe
districtbe assessedinresponseto a duly passed resolutionof intentionto createone or more special
improvement districtswhich would includetheabove-describedproperty.

In theeventa specialdistrictor specialimprovement districtisnot utilizedforthecompletion
oftheseimprovements,thedeveloperagreestoparticipateinan alternatefinancingmethod forthe
completionof saidimprovements on a fairshare,proportionatebasisas determinedby theCityon the
basisofthe squarefootageof property.taxablevaluationof theproperty,trafficcontributionfrom the
development or a combinationthereof.
This waiver ismade forthe benefitofthepropertydescribedhereinshallbe a covenant running
with the land.
The terms,covenantsand provisionsof thiswaiver shallextendto,and be bind.ingupon the
successors-in-interestand assignsof theLandowner.
