GRANTOR,in considerationof $1.00 and forotherand valuableconsideration,receiptof which
ishereby acknowledged,grantsto The City of Bozeman,a Municipal Corporationof the Stateof
Montana,with officesat 121 North Rouse Avenue,Bozeman,Montana 59715,GRANTEE,a
mutual drainage easement forthe use of the owners,through and acrossa portionof land situated
inGallatinCounty,Montana,which islocatedon the followingdescribedproperty:
Lots 1 -3,Block 5,Flanders Creek Subdivision[PlatJ-434],City of Bozeman,according to the
plat thereof,on fileand of record in the officeof the Clerk and Recorder,GallatinCounty,
Montana,and locatedin the Southwest 1/4 of Section 4,Township 2 South,Range 5 East of
P.M.M.
The easement ismore particularlyshown and dimensioned on the attachedExhibit A,which by
thisreferenceismade a partof thisdocument.
The GRANTORS warrant that they are lawfully seized and possessed of the real property
described above,thatthey have a lawful rightto convey an easement on said property,or any
part of it,and that they will foreverdefend the titleto thisproperty againstthe claims of all
persons.
The GRANTEE may peaceably hold and enjoy the rightsand privilegesherein granted without
any interruptionby the GRANTORS.The terms,covenants and provisionsof thiseasement
shallextend to and be binding upon theheirs,executors,administrators,personalrepresentatives,
successorsand assignsof the partieshereto.
