WAIVER OF RIGHT TO PROTEST
CREATION OF SPECIAL IMPROVEMENT DISTRICTS
FOR AUTUMN G ROVE-21479
The undersigned owner of the real property situatedin the County of Gallatin,Stateof
Montana,and more particularlydescribedas follows:
West Wind Sub Ph 5,Block 2,Lot 5,PlatJ-494,Section02,Township 02 South,
Range 5 East P.M.M.inthe City of Bo7_eman,GallatinCounty,Montana
IN CONSIDERATION of receivingapproval forsiteplan of the subjectpropertyfrom the
City of Bozeman,along with accompanying rightsand privilegesand for other and valuable
consideration,the receiptof which ishereby acknowledged,and in recognitionof the impacts to:
streetsand intersectionswhich will be which willbe caused by the development of the above-
described property,the owner has waived and does hereby waive for itself,itssuccessorsand
assigns forever the right to protest the creationof one or more specialdistrictsor special
improvement districtsforthe design and engineering,constructionand maintenance of following
improvements:
a.Streetimprovements to W.Oak Streetincludingpaving,curb/gutter,
sidewalk,and storm drainage.
b.Streetimprovements to Davis Lane includingpaving,curb/gutter,sidewalk,
and storm drainage.
c.Streetimprovements to Baxter Lane includingpaving,curb/gutter,sidewalk,
and storm drainage.
d.Intersectionimprovements to the intersectionof Davis Lane and Baxter Lane.
e.Intersectionimprovements to the intersectionofW.Oak Streetand N.
27th Avenue
f,Intersectionimprovements to the intersectionof W.Oak Streetand Ferguson Avenue.
Landowner agrees the City has the solerighttocontrolthedesign and constructionof such
improvements and may includeany of theabove components and othersnecessaryto ensure such
improvements comply with alladopted City infrastructureplans and requirements.Further,the
Landowner waives itsrightor to make any writtenprotestagainstthe si7_eor area orcreationof the
districtbe assessedinresponse toa duly passed resolutionof intentiontocreateone or more special
improvement districtswhich would includetheabove-describedproperty.
In the event a special districtor special improvement districtis not utilizedfor the
completion of these improvements,the developer agrees to participatein an altemate financing
method forthecompletion of saidimprovements on a fairshare,proportionatebasisasdetermined
by theCity on thebasisof thesquare footageof property,taxablevaluationof the property,traffic
contributionfrom thedevelopment or a combination thereof.
This waiver ismade for the benefitof the property described herein shallbe a covenant
running with the land.
The terms,covenants and provisionsof thiswaiver shallextend to,and be binding upon the
successors-in-interestand assignsof the Landowner.
