Landowner agrees the City has the solerighttocontrolthedesign and constructionof such improvements and may includeany of theabove components and othersnecessaryto ensure such improvements comply with alladopted City infrastructureplans and requirements.Further,the Landowner waives itsrightor to make any writtenprotestagainstthe si7_eor area orcreationof the districtbe assessedinresponse toa duly passed resolutionof intentiontocreateone or more special improvement districtswhich would includetheabove-describedproperty. In the event a special districtor special improvement districtis not utilizedfor the completion of these improvements,the developer agrees to participatein an altemate financing method forthecompletion of saidimprovements on a fairshare,proportionatebasisasdetermined by theCity on thebasisof thesquare footageof property,taxablevaluationof the property,traffic contributionfrom thedevelopment or a combination thereof. This waiver ismade for the benefitof the property described herein shallbe a covenant running with the land.
