Dear: City of Bozeman / Chris Saunders (or other most appropriate source): Re: PUD repeal / PDZ replacement of BMC 38.430 on Consent Agenda F.7 tomorrow 9/27/22 I hope that I might get a reply with answers to the these questions, I've only slightly modified from 9/19/2022 submission one week ago: When PUDs began? A) Code/regulations have been updated & replaced a number of times... When were PUDs first added to Bozeman Municipal Code? Ord 979 in 1976 first introduced PUDs. They have evolved substantially over time. The “modern” PUD was adopted with Ord 1332 in 1991 and has been amended several times since. {I am curious to know this, and looking for an approximate timeframe answer [exact dates not necessary.] If this is not known, it's ok.} When/Why PUDs were required?? B) It's been shown where PUDs have occurred in Bozeman to date, plus stated that these were REQUIRED--when was this and why? PUDs were required as part of the Residential Suburban zoning district until 2018. PUDs were required in the area of Oak Street and 19th Ave as an implementation of a small area plan shortly after the N 19th interchange opened. That plan has been repealed. The Commission required PUDs because they felt it was the best way to coordinate development given the tools then available. Since then that requirement was removed in 2012 and different coordination tools and standards have been adopted. {Wondering if the City of Bozeman could REQUIRE a PUD before, why not now? Why were PUDs "required" in past & range of years?} C) Options/Features for PUDs via preference or requirement: i) It was stated that PUD flexibility was offered only for 1 thing: "more Open Space" (is this correct or only originally in the beginning)? Ord 1332 required 30% open space with all PUDs whether there were sensitive lands present or not.. [More Open Space... see F) below] as it is a rather important and intentional outcome when PUDs are used/required in sensitive areas.] ii) Chris Saunders also has stated PUDs did offer 11 items that could be used for flexibility via PUD, what are/were these 11 areas? https://library.municode.com/mt/bozeman/codes/code_of_ordinances? nodeId=PTIICOOR_CH38UNDECO_ART4CODE_DIV38.430PLUNDE_S38.430.090PLUNDEDEOBCR 38.430.090.E.2.a(7) lists the possible means of obtaining performance points. [I have looked at and read BMC 38.430 but can't seem to identify as many as 11 separate features/items/options that exist/existed.] Restricted Size Lots (RSLs) or units?D) I know and can see that PUDs in 2005 were required to have x-# or some percentage of RSL(Restricted Size Lots). The RSL approach was an effort, not limited to PUDs, to support affordablehousing. It was adopted with a sunset period of five years. It was not renewed by the City Commission asit was not seen as having been sufficiently effective. Revised standards for minimums now allow smallerlots than were available under RSL.i) Why were smaller Lots and/or units required for at least some portion of the past (don't know range ofyears)?ii) Why are "smaller" sizes and/or RSLs no longer a requirement? Comment: With housing affordability & affordable housing being issues along with low supplies/housing crisis, it would seem that a smaller size Lot, and/or smaller size dwelling unit would potentially have lower costs to build + to purchase Land or developed unit(s). PUD repeal PDZ replacement--how attract use of?E) How will recently adopted PUD repeal with replacement by PDZ (Planned Development Zones) to beeffective October 23,2022 attract developers to use the PUD? [It was stated in the City Commissionmeeting that asks for the 3-4 categories of things in the past had not resulted in anyone taking upthe offers.] The PDZ offers flexibility to differ from the adopted standards as an incentive for use. It willdepend on the interests and intent of any given development project to decide if those incentives havevalue to them. [NOTE:, it was suggested by the Commission that PUDs be looked at for how much/often uses within the1st year of this new adoption--because if not used or only a few times, then likely CHANGES will need tobe made.] GOOD VISUAL EXAMPLE? FYI F) Attached is an example of 55 units in a Conventional Subdivision compared VISUALLY to a Planned Unit Development (PUD) from the American Planning Association (APA) Michigan Chapter. I feel it is quite EASY to "see" how clustering of development units/dwellings protects sensitive natural resources inthis visual which I found just browser searching on the Internet earlier this month (9-13-2022). PUDs areoften used for clustering or other site specific response and were previously used that way in Bozemanbefore the City adopted standard protections for wetlands and watercourses. Clustering is often requiredto use a PUD when large lot sizes are a minimum requirement (RS used to be 1 acre minimums) anduses limited to single homes. If lot area requirements are small then ability to cluster homes is inherent inthe district and if a mix of housing options are available designers can configure sites flexibly withoutresorting to the uncertainty and extra review processes in PUDs. All residential districts in Bozeman allowfor small lots and a range of housing options. Please respond via email with responses or call me by phone. Thanks--as I am keenly interested inPUDs/PDZs being useful & used. Thank you for having done that session and all of your answers to Board Member questions. However, I am hoping you/someone can reply on my questions... since PUD to PDZ appears before CityCommission on 9/27/2022. ----- Forwarded Message ----- From: Mary Wictor <mwictor@yahoo.com> To: Agenda <agenda@bozeman.net> Cc: Mary Wictor <mwictor@yahoo.com> Sent: Monday, September 19, 2022 at 11:00:07 AM PDTSubject: Public Comment 9/19/2022 ComDevBoard for PUD Question(s) as "Stump the Planner" Dear City of Bozeman for MON September 19, 2022 Community Development Board and appropriatestaff:re: Question(s) on Planned Unit Developments (PUDs) as Public Comment for Agenda Item H.2 underFYI / Discussions Per information related during recent meetings on PUD repeal & PDZ replacement, can you reply toprovide more info as follows: Submitting this multi-part Question for MORE INFO/BACKGROUND on Planned Unit Development(PUDs) 1) The code/regulations have been updated and replaced a number of times...
