Just getting back to you now on Christine’s question regarding waterway jurisdiction at 5400Fowler Road.
I’ve attached a marked-up excerpt from the 1953 Water Resources Survey (WRS) for Gallatin
County. As Christine described in her email, the waterway on this property is a lateral fromthe Middle Creek Ditch. I reviewed aerial photos back to 1995, and although the waterway
looks to have been manipulated on the property to some degree in the last 25 years, itcontinues to have originated from the main Middle Creek Ditch on the SE side of the Fowler
Rd./Patterson Rd. intersection. As such, this waterway is a ditch and considered non-jurisdictional from the CD’s standpoint.
I would also like to add that just a bit further north from this property, the CD has taken
jurisdiction over a couple smaller waterways as they approach and cross Stucky Road. At leastone of these shows as a blue line or stream on the WRS map (and USGS quad. map), others
showed as ditches on the WRS map, but today they collect enough irrigation returnflow/groundwater that we have elected to take jurisdiction on them from the general Stucky
Rd. area and continuing to the north. However, this property (5400 Fowler) ends up being justsouth of that area and I would still consider the waterway(s) as non-jurisdictional ditches,
albeit just to the south of the “transitional” area where some ditches become “stream-ditches”. MICHAEL ROTAR, PE, CFM

Hi Becky,Good to see you this morning. I’ve got a question for you regarding water course
designation. One of our development engineers was at a meeting with the City of Bozemanthis morning regarding development of a property located at 5400 Fowler Lane. The City
requested that the Conservation District provide determination on whether the water courseson the subject property are ditches, streams or stream/ditch.
I delineated the property this past fall and my research indicated that the watercourse that ran
parallel to Fowler is Middle Creek Ditch. I’m unsure what the other waterway is, but itterminates into a small pond on the northern boundary of the property. I’ve attached a series
of maps, for reference.
Could you provide guidance on these determinations or let me know what the correct courseof action is to get an official designation from your office?
