RE: Response to DRC 795 Manley Road Site Plan Application (#19003)
Dear Ms. Pope:
This letter is to provide a narrative response to the Development Review Committee from March
15, 2019. Responses to comments are in bold and italicized.
Section 2- Recommended Conditions
1. The applicant is advised that unmet code provisions, or code provisions that are not
specifically listed as conditions of approval, does not, in any way, create a waiver or other
relaxation of the lawful requirements of the Bozeman Municipal Code or state law.
The item is noted.
2. The sidewalk along Manley Road will need to be drawn in 1 ft east of the property line and
labeled as future sidewalk by others on the civil Site Plan.
C1.0 now shows the future sidewalk along Manley, 1-ft off of the east property line and is
labeled as such.
3. The Waiver of Right to Protest SID must be recorded with the Gallatin County Clerk and
Recorder’s office. Proof of this recordation must be provided to the city prior to site plan
approval. The applicant filed with the County Clerk and Recorder's office executed Waivers
of Right to Protest Creation of Special Improvement Districts (SID’s) for the following:
a. Street improvements to Manley Road including paving, curb/gutter, sidewalk, and
storm drainage
b. Street improvements to Griffin Drive including paving, curb/gutter, sidewalk, and
storm drainage
c. Intersection improvements to Manley Road and Griffin Drive
The Waiver of Right to Protest SID has been recorded with the Gallatin County Clerk and
Recorder Per Document #2640328. The waiver includes the SID’s listed a-c. above.
Civil/Structural Engineering and Surveying
Section 3- Required Code Corrections
Planning Division:
1. The elevation drawings show the electric meters on the south elevation, and the civil
drawings show the connection on the north side of the building. Revise as appropriate.
Landscape plan must be updated to show utilities at the south elevation of the building rather
than the north.
The Civil and Landscaping Plans showed utilities entering the southside of the building.
There are two existing utility stubs on the north side of the building that will be abandoned
by the utility provider. The landscaping plan has been updated to clarify this. L1.00-
Landscaping plan now shows the utilities connection along the south side of the building
rather than the north.
Engineering Division
1. BMC 38.410.080. Include the applicable section of the referenced Gallatin Park Subdivision
Report as an appendix to the Stormwater Design Report to verify the amount of runoff
included in the existing stormwater detention infrastructure.
The applicable section of the original stormwater report for Gallatin Park Subdivision is
now included in the stormwater design report in Section 7-Appendix A of the Site Plan
Application. The appropriate information is highlighted on the original document.
2. The proposed detention basin will need to be relocated out of the open space; this detention
basin was not a part of the original subdivision approval. It can also not be located over the
sewer service line.
An underground infiltration chamber system is now proposed to contain runoff from the
site. The proposed system shown on C2.0- Site Grading and Drainage Plan, located on the
west side of the property. Details of the chambers are included on an additional sheet,
C3.1.
