RE: Lot 13, Block 1 of Gallatin Park Subdivision - Waiver Request – Intersection Level
of Service
To Whom It May Concern:
A waiver is requested from Bozeman Municipal Code (BMC) Section 38.400.060.B.4 for the
Manley Road and Griffin Lane intersection for the site plan of the proposed office building at
Lot 13, Block 1 of the Gallatin Park Subdivision (C.O.B. #19003). The referenced code section
requires that all intersections with arterial and collector streets operate at a minimum level of
service (LOS) “C” for the design period of the development, which is a minimum of 15 years
following application approval. This intersection is currently operating at a LOS of “F” for the
AM Peak Hour and LOS of “D” for the PM Peak Hour conditions.
The above-referenced section allows the review authority to grant a waiver from a LOS of less
than “C” if it is determined that:
1. Granting of a waiver from the level of service for the intersection would not be contrary
to public health and safety and is in the public interest.
The proposed project is expected to generate 13 AM peak trips and 17 PM peak trips.
The existing intersection is currently operating at a LOS of “D” during AM peak hours.
The left turn lane from Manley on to Griffin drive is largely responsible for this LOS. The
proposed project is not likely to generate traffic in this lane, as most of the trips
generated are expected to be headed north on Manley, towards the proposed office
building during AM peak hours. As a result, the project is not expected to be contrary to
public health and safety.
2. Improvements to the intersection to raise the overall level of service to a “C” or better are
currently scheduled for commencement of construction within three years as shown on
the most recently adopted transportation capital improvement plan.
This intersection is on the Capital Improvement Plan and is scheduled within the next 3
years.

3. All right-of-way necessary for the required intersection improvements have been
obtained by the City or the Montana Department of Transportation.

improvements have been obtained.
4. The commission has approved a financing plan for the intersection improvements.
It is our understanding that the City has scheduled reconstruction of the intersection to
begin design in fiscal year 2020 and construction to begin in 2021 as Street Impact Fee
CIP number SIF110. There is no current proposed local share component to this
financing plan.
