WAIVER OF RIGHT TO PROTEST
CREATION OF SPECIAL IMPROVEMENT DISTRICTS
FOR:Annie SubdivisionPh.4 PreliminaryPlat(2305 Durston Road)
I,the undersigned Owner ofthe realpropertysituatedinthe County ofGallatin,State of
Montana,and more particularlydescribed as follows:
The tractof land described inPlatJ-482,being Lot 1 ofAnnie SubdivisionPhase 3C,
Section 2,Township 2 South,Range 5 East,P.M.M.,Cityof Bozeman,GallatinCounty,
Montana.
IN CONSIDERATION of receivingpreliminaryplatapproval from the Cityof Bozeman for
the Annie SubdivisionPh.4,along withaccompanying rightsand privilegesand forother
valuable consideration,the receiptof which ishereby acknowledged,and inrecognitionof the
impacts to Citytransportationand infrastructuresystems thatwillbe generated by the
development ofthe above-described property,do hereby forourselves,our heirs,personal
representatives,successors and assigns,waive the rightto protestthe creationofone or more
specialimprovement districts(SID's)forthe following:
1.Streetimprovements toWest Oak Streetfrom Hunters Way to North 19thAvenue
includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage.
2.Intersectionimprovements atNorth 19thAvenue and Durston Road includinglighting,
signalization,paving,curb/gutter,sidewaik,and storm drainage.
3.Intersectionimprovements atNorth 19thAvenue and West Oak Streetincluding
lighting,signalization,paving,curb/gutter,sidewalk and storm drainage.
Acceptance of a deed fora lotwithinthissubdivisionshallconstitutethe assent ofthe
owners to any futureSID,based on benefit,forupgrading the road withinthe Annie Subdivision
includingbut notlimitedto paving,curbs and gutters,non-motorized facilities,streetwidening
and drainage facilities,and may be used inlieuoftheirsignatureson an SID petition.
Inthe event an SID isnot utilizedforthe completion ofthese improvements,the
developer agrees to participateinan alternatefinancingmethod forthe completion ofsaid
improvements on a fairshare,proportionatebasis as determined by square footage ofproperty,
taxablevaluationofthe property,trafficcontributionfrom the development,or a combination
thereof.
This waiver shallbe a covenant running withthe land and shallnot expirewiththe
dissolutionofthe limitedliabilitycompany,provided however thiswaiver shallapply tothe lands
hereindescribed.
The terms,covenants and provisionsofthiswaiver shallextend to,and be bindingupon
the successors-in-interestand assigns ofthe Landowner.
