Hi Gary, Thank you for your patience in allowing me the time to respond to you questions regarding Kirk 2nd Sub, S12, T02 S, R05 E, Block 3, Lot 2, Plat F-37. For ease and to avoid confusion with Lot 2 (on the former Buttrey’s Shopping Center) to the south (Minor Sub 352, S12, T02 S, R05 E, Lot 2), I will refer to the property you are asking about as 1608 W Beall St. which is the property address as shown on the Montana Cadastral website. 1608 W Beall St. is immediately north of the former Buttrey’s (or Hastings) Shopping Center (BSC). I believe Hobby Lobby and Harbour Freight are currently in this shopping center. Historically, tetrachloroethene (PCE) was released at the BSC that contaminated groundwater, soil, and soil vapor that became the Bozeman Solvent Site. The Montana Department of Environmental Quality (DEQ) issued the Record of Decision (ROD) for the Bozeman Solvent Site in August 2011. The ROD identified the final cleanup remedy for the Bozeman Solvent Site. The ROD does not include any land use restrictions on 1608 W. Beall St. However, the ROD requires a construction trench and excavation permit system for fresh air mechanical ventilation in construction trenches or excavations to protect construction and utility workers along the eastern edge of 1608 W. Beall St. This permit system is administered by the City of Bozeman. Please see the attached. Trenches or excavations up to 100 ft long with the following dimensions will require the fresh air mechanical ventilation: less than 9 ft in width and greater than 10 ft in depth; less than 6 ft in width and greater than 7 ft in depth; and less than 3 ft in width and greater than 4 ft in depth. Trenches greater than 100 ft in length may require additional ventilation.
2Remedial activities on the BSC property described in the ROD require groundwater monitoring wells and soil vapor probes for performance monitoring purposes. Currently, there are a number of groundwater monitoring wells and soil vapor probes located near the southeast corner of 1608 W. Beall St. that are part of the performance monitoring program to evaluate remedial actions at the BSC. Specifically, groundwater monitoring wells EBM-5A, -5B, -5C. -5D, EBM-6A, -6B, and soil vapor probes EBSV-7 and EBSV-8. See the attached Figure. If these wells or probes are damaged or destroyed, DEQ may require them to be replaced. Please coordinate site plans and construction activities with Tasman Inc. (Tasman). Tasman conducts the remedial actions required by the ROD on behalf of the City of Bozeman and CVS Pharmacy. I’ll be glad to participate in any calls you have with Jim. Please note that 1608 W. Beall is also within the Bozeman Solvent Site Controlled Groundwater Area (CGWA). The CGWA limits groundwater well installation. In addition, if remedial actions (as defined by §75-10-701(20), MCA), such as mechanical fresh air during trench work, are conducted on the property, DEQ requires a third party work plan to be submitted for DEQ review and written permission. See Section 75-10-711(9), MCA and ARM 17.55.110. Please let me know if you have questions.
