RE: Oak & Cottonwood Apartments Concept Review, Application 19478
Project Description: This is a Conceptual Review application for advice and comments for the
proposal of seven apartment buildings that contain 84 units in total on a 3.1 vacant site the R-O
Zone District.
Project Location: Flanders Creek Subdivision Block 5, Lot 4 & 5.
We hope that these notes and suggestions assist you with the design and review of this potential
future project. Please note that comments are preliminary and based on information provided.
We appreciate your patience in the review process. All references below to Sections of the
Bozeman Municipal Code. If you have any questions or concerns or would like to set up a meeting,

Applicant Questions:
1. Before continuing further with site design development, we would like to confirm that
the placement of the buildings and parking is acceptable with Planning Staff. See
analysis below.
2. We would like to identify all infrastructure improvements both on and off the site that
will be required to complete the project. Engineering comments will cover this
question.
3. The location of the project is an ideal location for a new Transit stop being adjacent to
the High School and 84 new living units. We would like to inquire about requesting a
transit stop nearby if this is not already in the works. Provide documentation of transit
site location with letter from HRDC/Streamline the service extent, elevations of the
proposed transit stop, and a site plan of the whereabouts it will be located must be
provided.
The transit stop is already in place.

1. BMC 38.220. This project will require review by the Design Review Board during the Site Plan
process.
2. BMC 38.520.040.C.3. Crosswalks cannot be painted and must contain contrasting materials.
Crosswalks are now indicated by a stamped brick pattern and a contrasting color.
3. BMC 38.520.070.C. The sides and rear of service enclosures must be screened with at least 5
feet of landscaping. The trash enclosures do not meet this standard.
The trash enclosures have been relocated and redesigned to meet current standards. See
enclosure.
4. BMC 38.520.060.D. The common open space needs to include amenities.
The common open spaces now contain amenities.
5. It appears that the patios encroach into some of the setback. Encroachments must be shown
on the site plan.
6. There needs to be a 10 foot utility easement in front of buildings
The 10’ utility easement is now indicated along the front of the buildings.

2. Refuse enclosures will need to be covered.

1. Fire sprinklers and alarms required.
The buildings are now indicated as sprinkled.
2. Accessible parking spaces required in both covered and uncovered parking areas.
There are no covered parking spaces. Accessible parking spaces are now indicated.
3. Phasing plan for entire project is unclear. Phase one appears to be 48 units.
Phasing has been clarified. There are now 2 phases, the first consisting of 3 buildings, the
second will have the remaining 4
4. Required accessible/adaptable units.
a. Phase one (48 units)- 1- Type A accessible unit; 15- Type B adaptable units (ground
floor)
Each building will have (1) Type A accessible unit and (3) type B adaptable units on the
ground floor.

2. One internal fire hydrant is required centrally located.

1. Flanders Creek Subdivision provided parkland for 8 du/per acre. The balance for additional
density up to 12 du/per acre will be required as Cash-in-lieu of parkland (CILP).
2. BMC 38.420.030.C. The current adopted fair market value of land for Cash- or Improvements-
in-Lieu of Parkland is $1.60 per square foot; however, the fair market value of land for cash-
or improvements-in-lieu of parkland purposes is determined at the time of Site Plan
completion.
NorthWestern Energy; Thomas Stewart, thomas.stewart@northwestern.com
1. There are existing gas and electric utilities along the east and north side of Flanders Way and
3-phase electric on the west and gas stubbed on the east side of Twin Lakes Ave.
2. Need to show 10-ft utility easements along the east side of Twin Lakes to West Oak Street
and 10-foot utility easements along the west side of Cottonwood Road for utility services to

builds 1, 4 , 5, &7. Then 10 foot utility easements along the north side of the sidewalks, in the
parking area to provide needed utilities to the buildings 2 and building 3.
3. Need to show proposed meter locations and work with the NWE engineer to determine if the
locations meet NWE standards. Meters need to be on the closest corner of the building
nearest the transformer and/or gas main service tap location. Meter shall not be located
between buildings with narrow corridors that would hinder needed equipment to operate
properly, i.e. digging and rotate swing to place spoil piles two feet or more away from the
trench.
Issues above have been addressed. See civil site plan.
