RELEASE OF DEED RESTRICTION AGREEMENT
City of Bozeman Affordable Housing Program
WHEREAS,in considerationof receivingfinancialsupport from the City of Bozeman for the
purchase of realpropertylocatedat3165 MistralWay,Bozeman,Montana,on December 19,2019,
Mary M.Payne and Ben M.Austiguy (the "Recipients")entered into a Deed Restriction
Agreement with the City of Bozeman,recorded as document No.2668279 of the officialrecords
of the GallatinCounty Clerk and Recorder,GallatinCounty,Montana;and
WHEREAS,therealpropertysubjecttothe Deed RestrictionAgreement isdescribedas follows:
Lot 9 in Block 5 of West Winds SW Subdivision P.U.D.,City of Bozeman,Gallatin
County,Montana,according to the officialplatthereofon fileand of record in the office
of the County Clerk and Recorder,GallatinCounty,Montana.[JU-640]
WEST WINDS SW SUB,S 02,T 02 S R 05 E,BLOCK 5 LOT 9 ACRES 0.08538,PLAT
J-640
;and
WHEREAS,term of the Deed RestrictionAgreement continued untilthe repayment of allfunds
subjecttoa Deed ofTrustrecordedas Document No.2668278 of theofficialrecordsoftheGallatin
County Clerk and Recorder,GallatinCounty,Montana;and
WHEREAS,theCity of Bozeman,as Lender,enteredintoa Promissory Note with Recipientsas
Borrowers dated December 19,2019,promising topay theloanreferredtointheDeed Restriction
Agreement upon itsmaturity;and
WHEREAS,on July 19,2022,upon the Recipientssaleof the above describedrealproperty,the
City received payment in the amount of $52,368.00 pursuant to the requirements of the
aforementioned Deed of Trustand Promissory Note.
NOW THEREFORE,I,Gregory S.Sullivan,pursuanttomy authorityas cityattomey fortheCity
of Bozeman,Montana,and my authorityas Trustee under the aforementioned Deed of Trust,
declaretheDeed RestrictionAgreement and thePromissory Note tobe fullysatisfiedand no longer
of any force or effect,and thatthe restrictionsof said Deed RestrictionAgreement are hereby
terminated.
