As noted by this chain of emails, Mr Paine failed to give timely notice to all abutters to his project Six Range. As a result, many comments that should have been read and considered by the Community Development Board were not even received in time for them to consider. Their final decision was not based on reading the full response of the affected abutting owners and that meeting should have been canceled in order to allow time for all comments be read. Please take that in mind when you judge the decision of the Community Development Board. The late corrective noticing was a distinct disadvantage to those who wanted their comments to be considered. I am hoping that all the comments speaking directly about Bozeman City Code and personal observations will be duly noted by the person making the final decision. Apparently, the City did not receive the proper form and has now told the applicant they must submit it and re- notice. As Lynn noted, the public comment period will be extended. As for enforcement, I appreciate your interest. At this time the process we are undertaking is to redo the noticing and the public comment period. I am not taking any other action. Dear Greg, Did someone from Six Range sign the Declaration form certifying that the letters were sent. I realize an error was made but it was only dumb luck that we caught it. So the important issue to me is did Six Range say they sent the letters? Mr Paine has not been truthful with CT Condos through the entire review process and has bullied us with letters from his lawyer. If there are consequences for filing a bogus Declaration form, I’d like to know if that is going to be enforced. Dear Mr Sullivan, Six Range posted a sign on their land when the City declared the applicant had reached adequacy. However, no one within 200 feet of the lot was warned in writing about the proposal. It was only by chance that neighbors talked to neighbors did we find out nothing was mailed. Lynn Hyde confirmed the letters were not sent. My question is did Mr Paine or his agent sign the notification and the Declaration form certifying that he sent letters? If he did, I would like to see a copy of that Declaration form. The form says that the applicant or applicant agent is signing under the threat of perjury. How can we get assurance that the letters will be sent?
