Christthe King Lutheran Church of Bozeman,Montana,GRANTO.R,forgood and valuable
considerations,receiptof which ishereby acknowledged,grantsto The City of Bozeman,a
Municipal Corporation of the Stateof Montana,with officesat121 North Rouse Avenue,
Bozeman,Montana 59715,GRANTEE,a traileasement twenty-fivefeet(25')wide
("Easement")expresslyfora ten foot(10')wide trailand shared-usepath forthe use by the
publicin,through,and acrossthefollowingdescribedproperty:
Lot 1,Minor Subdivision No.253,located in the SE ¼SW ¼of Section 3,
Township 2 South,Range 5 East,P.M.M.,GallatinCounty,City of Bozeman,
Montana
("Property").
The Easement ismore particularlyshown,described,depicted,and dimensioned on the attached
ExhibitA which by thisreferenceismade a parthereof.The locationand dimensions of the
Easement shallnot be increasednor relocatedwithout the expresswrittenconsent of GRANTOR
or GRANTOR's successorsor assigns.
The GRANTOR agrees:
(1)The trailand shared-usepath forthe purpose of allowing non-motorized users,including:
bicyclists,pedestrians,skateboards,inlineskates,and thelike,with motorized use limited
topowered wheelchairs/scootersused by disabledcitizens.
(2)To allow thetrailand shared-usepath on the Property to be constructedby adjacent
propertyowner TrinityChurch,alsoknown as GallatinValley PresbyterianChurch,
accordingto the schedule agreed upon by GRANTOR and GRANTEE.The east-west
trailand shared-usepath shallbe ten feet(10')wide and constructedof asphaltto a Class
IB condition.
(3)To maintain and repairthetrailand shared-usepath on the PropertyatGrantor'sexpense
includingmaintenance of surrounding landscapeand snow removal in accordance with
cityordinancearticle6,sections34.06.010-34.06.060.
(4)To allow the City to make any and allinspectionsofthe Easement as theCity reasonably
deems necessary.

The GRANTOR statesthatGRANTOR islawfullyseizedand possessed of theProperty
describedabove,thatGRANTOR has a lawfulrightto grantan easement thereon.
The GRANTOR furtheragrees thatthe GRANTEE may peaceably hold and enjoy the
rightsand privilegeshereingrantedwithout any interruptionby the GRANTORS.The terms,
covenants and provisionsof thiseasement shallextend to and be bindingupon the successors
and assignsof thepartieshereto.
