a. Variance 2021-009: Year-round use (non-seasonal) of an existing holding tank. Administrative
Rules of Montana (ARM) 17.36.916(5)(a) requires holding tanks to be seasonal-use only.
2. Variance Request by Walter R Sales LLC, TBD Heeb Road, Described on Deed Book 29, Page 533,

a. Variance 2022-009 Installation of a wastewater treatment system (Elevated Sand Mound) in an
area that does not meet the 4-ft of vertical separation of natural ground surface to groundwater
as required by Administrative Rules of Montana 17.36.914(3).
b. Variance 2022-010: Installation of a wastewater treatment system (Elevated Sand Mound) in
an area that has not been monitored for depth to seasonally high groundwater pursuant to ARM
17.36.914 (5)(c) and Circular DEQ4 (2013) Appendix

located in an area that does not meet the required 100-foot setback from the 100-year floodplain

Block B, Lot 8, Duck Bay area, Section 34, Township 12S, Range 4E, PMM, Gallatin County
a. Variance 2022-015: Installation of a replacement wastewater treatment system where the
transport line (sealed component) will be located less than 50 feet from the existing drinking
water well. (Administrative Rules of Montana (ARM) 17.36.918(1) Table 1 and Footnote 1. The
transport line will come to within 42 feet of the existing drinking water well under this proposal.
